3.23.040 Transfers from trust funds.
Transfers may be made from a trust created and established by this chapter by order of the city manager or the city treasurer only if the transfer is made from appropriations budgeted by the Walla Walla city council in such trust fund for the purposes of such approved appropriations or made for purposes of an investment made to benefit the trust in accordance with the Chapter 3.05 of the Walla Walla Municipal Code; the transfer is made in furtherance of the purposes of the trust; and the transfer is not otherwise prohibited by state law, regulations of the Division of Municipal Corporations of the Office of the State Auditor, the Walla Walla municipal code, or other ordinances or resolutions of the Walla Walla city council. Any moneys in a trust fund at the end of the fiscal year of the city shall not lapse and are not subject to reappropriation by the council to another fund in the adoption of a subsequent budget unless the reappropriation is consistent with the trust and the transfer is not otherwise prohibited by state law or regulations of the Division of Municipal Corporations of the Office of the State Auditor. 3.23.050 Deposits to trust funds.
Gifts, and principal and interest from trust investments which are not re-invested shall be deposited into the trust fund for which they are dedicated for the purposes of said trust, and transfers of such gifts, principal and interest may be made only as provided in Section 3.23.040. (Ord. 99-6 § 24(part), 1999).
3.23.060 Cemetery trust fund.
There is created and established a fund to be held in the trust by the city, which fund is named the cemetery trust fund.
A. The object and uses of such fund are:
1. Any person may make donations to such fund in addition to the endowed care charges paid for gravesites.
2. Any and all sums so donated shall be paid to the city treasurer, and upon such payment, shall be accepted by the city, and held in trust for the uses and purposes of the fund.
3. The city obligates and binds itself to safely keep the moneys donated to such fund, to invest the same in accordance with Chapter 3.05 of this title, and to use the income so realized in caring for, maintaining and beautifying the lots and the graves thereon, in the manner hereinafter specified.
B. Before the city treasurer shall receive from any person or persons being the owner or owners of any lot, lots, or fraction of a lot, the donation herein before specified, such owner or owners shall certify in writing, attested as to its correctness by the cemetery supervisor, to the following effect:
1. That the lot, lots or fraction of a lot, describing it or them, has or have been placed on the grade required and established for lots in that locality;
2. That the graves, if any, thereon have been leveled so that the surface of the grave shall conform to the general level of the surface of such lot or lots;
3. That all fanciful and temporary ornaments, and all flowers or shrubbery, except such as are perennial in their habits or nature, have been removed therefrom.
C. It is made the duty of the cemetery committee:
1. To see that the moneys are invested by the investment committee;
2. To expend the income therefrom on the care, maintenance and beautifying of the lots in the care of such fund, and to see that the cemetery supervisor properly cares for, maintains and beautifies such lots, as far as the income from the fund will justify or permit; and
3. To make all rules and regulations necessary to carry into effect the terms of subsections B, (C)(2), and (C)(3); provided, that such rules and regulations shall be reported to the city council for ratification.
D. The principal of the cemetery trust fund heretofore established, together with any additions thereto, shall be invested and reinvested, from time to time. All income from the fund shall be used exclusively for the upkeep and maintenance of the portion of such cemetery under “perpetual care.” (Ord. 99-6 § 24(part), 1999).
3.23.070 Public library trust fund.
There is created and established a fund to be known as the public library trust fund. The city treasurer shall account for each gift to such fund.
A. The principal of said fund may be invested and reinvested, from time to time in accordance with Chapter 3.05 of this title. The fund shall be used exclusively for the purchase of books and materials, for the library. (Ord. 99-6 § 24(part), 1999).
3.23.080 Ellen Garfield Smith library building trust fund.
There is created and established the Ellen Garfield Smith library building trust fund, which fund shall be utilized in compliance with the state’s budgetary procedures for the receipt and disbursement of the funds bequeathed to the city by Ellen Garfield Smith, the funds to be used especially and solely for the enlargement and improvement of the city’s public library building. (Ord. 99-6 § 24(part), 1999).
3.23.090 Peter and Esther Eyraud trust fund.
There is created and established a fund to be known as the Peter and Esther Eyraud trust fund. This fund is created for the purpose of purchasing children’s books and reference books on sports for the Walla Walla public library in accordance with the provisions of the Esther Eyraud memorial library trust fund agreement made on June 4, 1977. (Ord. 99-6 § 24(part), 1999).
3.23.100 Sherwood library trust fund.
There is created and established a fund to be known as the Sherwood library trust fund. This fund is created for the purpose of purchasing library materials in accordance with the provisions of Donald and Virginia K. Sherwood library trust fund agreement made on May 29, 1980. (Ord. 99-6 § 24(part), 1999).
3.23.110 Aviary trust fund.
There is created and established a fund to be known as the aviary trust fund. This fund is created for the purpose of receiving gifts, donations, and other funds to be used for the costs of operation, maintenance or repair of the facilities, buildings, and equipment for the Pioneer Park Aviary, the purchase of wildlife for the aviary, and the construction of capital facilities needed for operation of the aviary. 3.23.120 Park progress fund.
There is created and established a fund to be known as the park progress fund.
A. Persons who desire to voluntarily contribute to the improvement of the city’s parks and recreation facilities shall be entitled to do so by indicating the amount of such contribution on the monthly municipal utilities bill and all moneys received by the city treasurer in payment of the bills which represent voluntary contributions as indicated thereon, which moneys shall then be used for capital improvements within the park system of the city.
B. In order to effectuate the provisions of this chapter, the city administration is directed to amend and revise the municipal utilities monthly bill in order to enable individuals or persons desiring to make such contribution to indicate the same thereon and the amount of such contribution, and to further implement such other procedures as are deemed necessary and appropriate to facilitate such program. 3.23.130 Code enforcement revolving fund.
There is created and established the code enforcement revolving fund, which fund shall be utilized in compliance with the Uniform Code for the Abatement of Dangerous Buildings (adopted by Section 15.04.010) for the purpose of funding and financing private contractors who are engaged by the city to demolish unsafe structures and clean unkempt properties when the owners of such structures or properties fail to respond to notices from the city that such action is needed.
A. The development services director and police chief are directed to coordinate and make a recommendation to the city manager and council concerning the amount of such code enforcement revolving fund and the source of the funds, and are further directed to provide that a primary source of such funds shall be recovery of costs from the owners of unsafe structures and unkempt properties as provided by the above-referenced code provisions. 3.23.140 Street tree trust fund.
There is created and established a fund to be known as the street tree trust fund. This fund is created for the purpose of planting trees on city property and associated expenses, and to provide funds for the operation of the Urban Forestry Advisory Commission. (Ord. 99-6 § 24(part), 1999).
3.23.150 Emergency medical trust fund.
There is created the emergency medical trust fund, which fund shall be utilized in compliance with the state of Washington’s budgetary procedures for the receipt and disbursement of gifts and donations provided to the city in connection with its fire department or ambulance service. During such time as the city continues to operate an ambulance service, such funds shall be solely utilized for the purpose of acquiring equipment, supplies or services of an emergency medical nature, or as such designated gifts or donations may otherwise provide.
A. Each gift or donation received by the city for a specific designated purpose within the emergency medical trust fund shall be placed in a reserve account within such fund for such designated, specific purpose.
B. The emergency medical trust fund shall continue to exist until such time as the city discontinues the operation of its ambulance service. Upon the discontinuance of the city’s operation of an ambulance service, any remaining balance in the emergency medical trust fund shall be transferred to the city’s general fund, and the emergency medical trust fund shall thereupon be terminated.
