13.07.010 Purpose.

The purpose of this chapter is to establish a special charge applicable in the Cottonwood trunk system service area to reimburse for the cost of construction of water and sewer extensions into the Cottonwood region. (Ord 2001-10 § 1 (part), 2001).

13.07.020 Cottonwood trunk system service area defined.

The Cottonwood trunk system service area consists of all properties which either directly or indirectly have water or sewage service available through the water or sewer mains extended from inside the city southerly along Cottonwood Road. This area is designated on an official map maintained in the offices of the city of Walla Walla development services division. (Ord 2001-10 § 1 (part), 2001).

13.07.030 Mandatory connection.

Anyone connecting to receive water service from the city in the Cottonwood trunk system service area must also connect to receive sewage service from the city. Anyone connecting to receive sewage service from the city in the Cottonwood trunk system service area must also connect to receive water service from the city. Both water and sewage service from the city must be maintained by anyone receiving such services and no one shall have the option of receiving one service without the other. (Ord 2001-10 § 1 (part), 2001).

13.07.040 Cottonwood trunk system special charge is supplemental.

The Cottonwood trunk system special charge shall apply in addition to any other applicable fees, charges, rates, costs, and penalties. (Ord 2001-10 § 1 (part), 2001).

13.07.050 Net developable area and base density defined.

A. The net developable area of a parcel, whether a standard subdivision or a planned unit development (PUD) shall be the gross area of the property, less the area of any designated flood plane, less twenty-five percent to account for public rights-of-way.

B. The base density for a parcel shall be the net developable area divided by nine thousand six hundred square feet.

C. To accommodate variations in topography, physical features such as streams, and design factors such as irregularly shaped cul-de-sac lots, short plats and subdivisions creating individual lots may have an overall density of ten percent less than the maximum density provided by the nine thousand six hundred square feet base lot size.

Example:

(a) Gross area of the parcel is 261,361 sq. ft. (6 acres)

(b) Public right-of-way is 65,340 sq. ft. (25% of gross)

(c) 261,361 sq. ft. – 65,340 sq. ft. = 196,020 sq. ft. (net area)

(d) 206,475 sq. ft. / 9,600 sq. ft. = 21.5 units

(e) 10% of 21.5 units = 2.15 units (rounded to 2 units)

(f) 21 units – 2 units = 19 units.

In this example, the six acre parcel could have nineteen, twenty, or twenty-one lots and qualify for the base density charge described in Section 13.07.060(A)(1).

When the above calculation results in a unit fraction of 0.5 or greater in line (e) of the above equation, the unit count shall be rounded up to the next greater whole number.

D. No exception shall be given to the nine thousand six hundred square feet base density for a multiple unit or cluster development. (Ord 2001-10 § 1 (part), 2001).

13.07.060 Cottonwood trunk charge.

The following provisions shall be used to determine the Cottonwood trunk system special charge which applies to any property or development receiving service through the Cottonwood trunk system, whether by direct connection, or through intervening lateral mains connected to the Cottonwood trunk system.

A. The following calculations shall be used to determine the Cottonwood trunk system special charge for individual lots or multilot developments made up of lots intended for individual sale (typical short plat or subdivision lot developments).

1. Base Density Charge. Individual lots of nine thousand six hundred square feet or smaller shall be charged in an amount set forth in the city’s rate ordinance(s).

2. If the overall density of a subdivision qualifies for the ten percent exception described in Section 13.07.050(C), lots in the subdivision which are over nine thousand six hundred square feet will qualify for the base density charge in an amount set forth in the city’s rate ordinance(s).

3. For lots over nine thousand six hundred square feet, the charge shall be determined by subtracting nine thousand six hundred from the lot size, and multiplying the number of square feet in excess of nine thousand six hundred by an excess factor in an amount set forth in the city’s rate ordinance(s). The product of this multiplication is then added to the base density charge.

Example: (using a base density charge of one thousand five hundred fifty dollars)

(a) Lot size = 12,500 sq. ft.

(b) 12,500 sq. ft. – 9,600 sq. ft. = 2,900 sq. ft.

(c) 2,900 sq. ft. × $0.162/sq. ft. = $469.80

(d) $1,550 + $469.80 = $2,019.80

B. The following calculations shall be used to determine the Cottonwood trunk special charge for planned unit developments which involve common open space and one or more of the following: clustering of single-family or duplex units; zero lot line development; multiple unit construction.

1. The net buildable area of the development is determined by subtracting the public right-of-way and any designated flood plain from the gross area of the parcel being developed.

2. The Cottonwood trunk special charge is determined by dividing the net buildable area by nine thousand six hundred square feet. The charge for the development shall be the number of units available at nine thousand six hundred square feet per unit multiplied by the base density charge set forth in the city’s rate ordinance(s).

Example: (using a base density charge of one thousand five hundred fifty dollars)

Gross area of the parcel is 261,361 sq. ft. (6 acres)

Public right-of-way is 54,885 sq. ft. (21% of gross)

(a) 261,361 sq. ft. – 54,885 sq. ft. = 206,475 sq. ft.

(b) 206,475 sq. ft. / 9,600 sq. ft. = 21.5 units

(c) 21 units (rounded) × $1,550 per unit = $32,550

3. In cases where a developer, through processes described in Chapter 19.26, Planned Unit Developments, generates a density bonus in excess of the base established by the nine thousand six hundred square feet density, the Cottonwood trunk special charge need only be paid on the number of units established by the nine thousand six hundred square feet base density.

4. In cases where a developer proposes fewer units than the number determined by the formula in subsection (B)(2) of this section, the Cottonwood trunk special charge shall still be paid on the number of units calculated by that formula. 13.07.070 Payment of Cottonwood trunk system special charge.

A. Standard subdivisions as described in Subsection 13.08.060(A) shall pay the Cottonwood trunk special charge as follows:

1. Developments which meet the base density, or are within the ten percent allowable variation from the base density may pay the Cottonwood trunk system special charge for each lot individually as building permits are issued. These charges may be paid by the developer of the subdivision, or by the new owner of the lot when permits are issued.

2. Developments which exceed the ten percent allowable variation from the base density shall have the Cottonwood trunk system special charge for all lots paid by the developer of the subdivision prior to recording of the final plat.

B. Planned unit developments, as described in subsection 13.08.060(B) may pay the Cottonwood trunk system special charge unit-by-unit as building permits are issued for each unit in the development. (Ord 2001-10 § 1 (part), 2001).

13.07.080 Cottonwood trunk system special charge – Fund usage.

Cottonwood trunk system special charges received by the city shall be deposited in the water reserve account of the water fund and the wastewater reserve account of the wastewater fund in the following manner: sixty-six percent of the amounts received shall be deposited into the wastewater fund and thirty-four percent shall be deposited into the water fund.
