5.20.010 Hours of operation.

A. No tavern, cabaret or lounge, or employee thereof, shall serve or allow to be consumed upon the premises any liquor, including alcohol, spirits, wine and beer, as defined in RCW Title 66, nor permit the removal of any such liquor from the premises in any manner whatsoever on any day between the hours of two a.m. until eight a.m.

B. No retailer, grocery store, gas station, or other business having a license to sell alcohol, spirits, wine and beer, or employee thereof, other than a tavern, cabaret or lounge, or employee thereof, shall sell or allow to be sold, or permit the removal of, any such liquor from the premises in any manner whatsoever on any day between the hours of twelve a.m. until eight a.m., except for those alcoholic beverages discussed in subsection C of this section.

C. No retailer, grocery store, gas station, or other business having a license to sell alcohol, spirits, wine and beer, or employee thereof, other than a tavern, cabaret or lounge, or employee thereof, shall sell or allow to be sold, or permit the removal of, any liquor with an alcohol content greater than six percent from the premises in any manner whatsoever on any day between the hours of twelve a.m. until eight a.m. (Ord. 1163(part), 2007)

5.20.020 Liquor license issuance--Background information to be provided.

A. Before the city council of the city of Wapato shall vote upon whether or not it approves of the applicant or the location of any proposed new or renewed state liquor license, the city clerk/treasurer and departments of the city, including the police department and the fire department, shall provide background information to the city council at least one meeting prior to the council’s vote upon said application. Any tavern, cabaret or lounge proposing a new or renewal of state liquor license shall provide any documentation requested by the city clerk/treasurer for the city council’s review.

B. The information to be provided to the city council shall include, but not necessarily be limited to, the following:

1. Public records from the Liquor and Cannabis Board and local law enforcement of any violations by the applicant, including, but not limited to, fights, overservice, serving of minors, and how many of the violations were alcohol- or drug-related, during the two-year period immediately preceding the date of the application or renewal; and

2. Whether the location meets the following criteria:

a. All federal, state, and local building code provisions, including, but not limited to, Title 15;

b. That the premises meets all zoning ordinances and requirements.

C. Applicants for renewal of a license to operate at the same location shall be exempt from the criteria set forth in subsection (B)(2) of this section. (Ord. 2022-5 §4, 2022; Ord. 1163(part), 2007)

5.20.030 Violations.

A violation of Section 5.20.010 is a misdemeanor, punishable by up to ninety days in jail and a one thousand dollar fine, or both. (Ord. 1163(part), 2007)
