Appendix Chapters A, B, C, D, E, F, G, H and I (see International Fire Code Section 101.2.1, 2012 Edition), as published by the International Code Council, be and are hereby adopted as the fire code of the city of Westport, in the state of Washington, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees thereof; and each and all of the regulations, provisions, penalties, conditions and terms of said fire code on file in the office of the city of Westport are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in WMC 16.04.020. 16.04.020 Amendments.

The following sections of the International Fire Code adopted in WMC 16.04.010 are hereby amended as follows:

Section 101.1. Insert city of Westport.

Section 109.3. Insert Misdemeanor, $500.00, 90 days.

Section 111.4. Insert $250.00, $500.00. (Ord. 1537 § 1, 2013)

16.04.030 Appeals.

Section 108 of the International Fire Code adopted in WMC 16.04.010 is repealed in its entirety, and replaced with the following new section:

Section 108 Appeals. Whenever the Chief of the fire department disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the code do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal the decision of the chief of the fire department to the city council within thirty days from the date of the decision appealed. The appeal must be submitted in writing and must clearly state both the decision that is being appealed, and the basis for the appeal.

16.04.040 Geographic limits.

The geographic limits referred to in the following section of the International Fire Code adopted in WMC 16.04.010 are established as follows:

Section 3204.3.1.1. All zones within the city of Westport with the exception of the Marine Industrial (MI) and Mixed Use Tourist Commercial (MUTC) zones that border the Westport Marina.

Section 3404.2.9.5.1. The maximum size of any storage tank will be limited to 240 gallons for residential uses within the Ocean Beach residential (OBR), Residential (R), and MUTC zones within the city.

Section 3406.2.4.4. The maximum size of any storage tank will be limited to 240 gallons for residential uses within the Ocean Beach residential (OBR), Residential (R), and MUTC zones within the city.

Section 3804.2. All zones within the city of Westport with the exception of the Marine Industrial (MI) and Mixed Use Tourist Commercial (MUTC) zones that border the Westport Marina. (Ord. 1537 § 1, 2013)

16.04.050 Fire system plan review and permit fees.

The valuation of fire sprinkler and plan review fees shall be based on a cost estimate provided by the fire suppression system contractor or agent at the time of permit submittal. The cost estimate shall include the total cost of labor and materials for a complete installation.

Fire suppression installation permit fees shall be based on Table 1-A of the Uniform Building Code, 1997 Edition. In addition to the fire suppression installation permit fee a plan review fee shall be assessed and shall be equal to 65 percent of the fire suppression installation permit fee.

The fire chief may waive the submission of plans, calculations, construction inspection requirements and other data if it is found that the nature of work applied for is such that reviewing plans is not necessary to obtain compliance with the International Fire Code. (Ord. 1537 § 1, 2013)

16.04.060 Conflicting ordinances, resolutions or policies repealed.

If any provisions of existing ordinances, resolutions, or policies are found to be in conflict with the provisions of this chapter, or the International Fire Code adopted in WMC 16.04.010, then the provisions of this chapter and the International Fire Code shall govern. (Ord. 1537 § 1, 2013)

16.04.070 Severability.

If any section, subsection, sentence, clause or phrase of this chapter is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this chapter. The city council hereby declares that it would have passed the ordinance codified in this chapter, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. 16.04.080 Effect on pending matters.

Nothing in this chapter or in the International Fire Code adopted in WMC 16.04.010 shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed by this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter. 16.04.090 Effective date.

This chapter and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect five days from and after the date of its final passage and adoption. (Ord. 1537 § 1, 2013)
