17.30.010 Shoreline overlay (SO).
A. Policy. The shoreline overlay is designed to create a link between this title and the town shoreline master program (SMP). The overlay is a concept intended to overlay underlying zoning requirements with the more restrictive provisions of the SMP as well as provide the administrator and project proponents with a streamlined review process.
B. Uses Permitted. Information on permitted uses, development standards and regulatory requirements are found in the town SMP.
C. Lot Size, Allowable Densities, Lot Coverage, Height and Setbacks. Lot sizes, allowable densities, lot coverage, height and setback requirements in the shoreline overlay shall be as set forth in underlying zoning district, except where the requirements of the town SMP are more restrictive. In all such cases the more restrictive requirements shall apply.
D. Signs. Signage in the shoreline overlay shall be as set forth in underlying zone district, except where the requirements of the town SMP are more restrictive. In all such cases the more restrictive requirements shall apply. Where applicable, signs must also comply fully with Chapter 15.08 of the Winthrop Municipal Code, or any amendments thereto or any replacements thereof. (Ord. 489 § 8 (part), 1998)
17.30.020 Conservancy overlay (CO).
A. Policy. The conservancy overlay is designed to provide protection via design and environmental review for development and uses in those nonshoreline and floodplain areas designated as “conservancy” in the town comprehensive plan. Such protection is necessary to protect steep slopes and other areas defined as “critical” by RCW 36.70A.
B. Uses Permitted. In a conservancy overlay those uses shall be permitted as set forth in the table of permitted land uses in Chapter 17.16 for the underlying zone district. All uses shall comply with the performance standards set forth in Section 17.30.040.
C. Lot Size. Allowable Densities, Lot Coverage, Height and Setbacks. Lot sizes, allowable densities, lot coverage, height and setback requirements in the conservancy overlay shall be as set forth for the underlying zone district.
D. Signs. In a conservancy overlay signs shall be permitted subject to the requirements of the underlying zoning district. Where applicable, signs must also comply fully with Chapter 15.08, or any amendments thereto or any replacements thereof. (Ord. 489 § 8 (part), 1998)
17.30.030 Westernization overlay (WO).
A. Policy. The town is dependent on tourism for its economic well-being and the design review process established in Chapter 15.08 is an important element in ensuring that the town remains aesthetically attractive to visitors. The westernization overlay establishes a zone district which requires that commercial and other designated uses comply fully with Chapter 15.08, or any amendments thereto or any replacements thereof.
B. Uses Permitted. In a westernization overlay those uses shall be permitted as set forth in the table of permitted land uses in Chapter 17.16 for the underlying zone district. All uses shall comply with the applicable requirements set forth in Chapter 15.08 or any amendments thereto or any replacements thereof.
C. Lot Size, Allowable Densities, Lot Coverage, Height and Setbacks. Lot sizes, allowable densities, lot coverage, height and setback requirements in the westernization overlay shall be as set forth for the underlying zone district.
D. Signs. In a westernization overlay signs shall be permitted subject to the requirements of the underlying zone district and as set forth in Chapter 15.08. (Ord. 489 § 8 (part), 1998)
17.30.040 Overnight rental overlay (ORO).
A. Policy. The overnight rental overlay establishes additional areas where overnight rentals may be permitted outside of those zones identified in Table 17.16.010. Overnight rental uses within the overlay must comply fully with Section 17.12.035, or any amendments thereto or any replacements thereof.
B. Allowed Uses. In the overnight rental overlay those uses shall be allowed as set forth in the table of allowed uses in Chapter 17.16 for the underlying zone district. In addition, overnight rental uses may be allowed in compliance with the provisions of Section 17.12.035.
C. Lot Size, Allowable Densities, Lot Coverage, Height and Setbacks. Lot sizes, allowable densities, lot coverage, height and setback requirements in the overnight rental overlay shall be as set forth for the underlying zone district.
D. Signs. Signs for overnight rental uses within the overlay district shall comply with Section 17.12.035. (Ord. 714 § 1 (Exh. A)(part), 2019)
17.30.050 Development standards for overlay zones.
A. Development within areas covered by the shoreline overlay shall be subject to standards and requirements of the town shoreline master program (SMP). Whenever a conflict arises between the standards and regulations contained within the SMP and this title, the more restrictive provisions shall apply.
B. Standards. The following development standards shall be mandatory for all development and uses in areas covered by the conservancy overlay:
1. Approved landscape plans shall be implemented as soon as weather allows after completion of construction, which will provide plantings which, either separately or combined with wood fencing or earthen berms, provide visual screening of parking areas, trash areas and other service areas of the development, and break up the visual impact of the development from public roads and neighboring properties, and which will eliminate and prevent the occurrence of noxious weeds. Landscaping must be maintained to assure viability of plantings; underground or other timed outdoor water systems may be required by the administrator for water conservation.
2. Storm water shall be channeled and disposed of by dispersal through a grassy area of sufficient size for the anticipated amount of storm water runoff, or by release into a properly designed dump area with filtration system or devises installed (including oil/water separator if called for by the size of development and the amount of traffic to be generated thereby, and by the size of the paved areas and other impervious surfaces) or other acceptable method to assure no degradation of the surface or ground waters.
3. Dust control measures shall be implemented to provide assurance of continual dust control during construction and upon occupation of the development. All roads and parking areas shall be paved or similarly surfaced to provide long-term dust control.
4. Dog control measures shall be mandatory within the conservancy overlay.
5. Compliance with the provisions and procedures of the State Environmental Policy Act and local regulations thereunder shall precede any applicable development.
C. Review and Approval. The administrator shall review the measures proposed for compliance with these development standards and shall approve or conditionally approve a building permit application to assure compliance with these standards.
D. The storage, treatment, processing and manufacture of hazardous materials and/or waste shall be prohibited in shoreline and conservancy overlays.
E. Construction on slopes exceeding fifteen (15) percent shall require detailed plans and specifications and be designed to minimize adverse impacts to the environment. (Ord. 714 § 1 (Exh. A)(part), 2019; Ord. 489 § 8 (part), 1998. Formerly 17.30.040)
