RECKLESS DRIVING, SPEEDING, DRUNK DRIVING

9.36.010 Reckless Driving.
No person shall drive any vehicle in willful or wanton disregard for the safety of persons or property.

9.36.020 Negligent Driving.
No person shall operate any vehicle in such a manner as to endanger or be likely to endanger any persons or property. The offense of operating a vehicle in a negligent manner shall be considered to be a lesser offense than, but included in, the offense of operating a vehicle in a reckless manner, and any person charged with operating a vehicle in a reckless manner may be convicted of the lesser offense of operating a vehicle in a negligent manner.

9.36.031 Speeding – Generally.
No person shall drive a vehicle on a county road at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing. In every event speed shall be so controlled as may be necessary to maintain control of the vehicle and to avoid colliding with any person, vehicle or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use due care.

9.36.032 Speeding – Maximum Limits Designated.
Except when a special hazard exists that requires lower speed for compliance with YCC 9.36.031, the limits specified in this section shall be maximum lawful speeds, and no person shall drive a vehicle on a county road at a speed in excess of such maximum limits.

(i) No person shall operate a vehicle at a speed in excess of fifty miles per hour on any county road not specifically identified in this section, as provided in RCW 46.61.400.
(j) No person shall operate a vehicle at a speed in excess of twenty-five miles per hour upon any county road designated by resolution of the County Commissioners as open to snowmobile traffic concurrently with motor vehicles.
(k) No person shall operate a vehicle at a speed in excess of twenty miles per hour upon the following county roads when flagged or flashing during school hours:

9.36.033 Speeding – Signs to Be Posted.
All of the maximum speed zones and limits as fixed in Section 9.36.032 shall be properly signposted at the extremities thereof and also at such intermediate locations as the county engineer shall determine necessary as soon as practical after the adoption of the ordinance codified in this section.

9.36.034 Speeding – Violation, Traffic Infraction.
Any person who shall violate any of the provisions of Section 9.36.032 shall be guilty of a traffic infraction.

9.36.035 Temporary Alteration of Speed Limits.
The Board of County Commissioners of Yakima County may by resolution provide for the temporary alteration of speed limits during road construction projects, which temporary alterations shall have the same effect as if they were included in section 9.36.032 of this chapter.

9.36.040 Minimum Speed Regulation.
No person shall drive a motor vehicle at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with the law. Whenever the board of county commissioners determines on the basis of an engineering and traffic investigation that slow speeds on any part of a highway or road unreasonably impede the normal movement of traffic, it may determine and declare a minimum speed limit there which shall be effective when appropriate signs giving notice thereof are erected. No person shall drive a vehicle slower than such minimum speed limit except when necessary for safe operation or in compliance with law.
