17.55.010 General.
No application filed pursuant to this title shall be considered complete unless and until all fees due pursuant to this title shall have been paid. Every approval granted and every permit issued pursuant to this title, whether or not expressly so conditioned, shall be deemed to be conditioned upon payment of the required fees. The failure to fully pay such fee when due shall be grounds for the Town of East Troy to refuse to process or to continue to process application and for denying or revoking any permit or approval sought or issued with respect to the land or development to which the unpaid fee relates.
In no event shall such unpaid fees remain unpaid at the time any approval granted by the Town of East Troy is recorded, as in such case, the Town of East Troy shall charge a fee double to that which remains unpaid at the time of recording. In addition, the violation of this section regarding prompt payment of fees shall also entitle the Town to recover actual attorney’s fees and other costs of prosecution.
The subdivider shall pay all fees to the Town Treasurer as hereinafter required and at the times specified before being entitled to record a plat or certified survey map. (2008 code § 18.11(1))
17.55.020 Preliminary plat or certified survey map review fee.
The subdivider shall pay a fee in the amount of $250.00 plus $25.00 for each lot or parcel within the preliminary plat to the Town Treasurer at the time of first application for approval of any preliminary plats to assist in defraying the cost of review. A reapplication fee in the amount of $30.00 shall be paid to the Town Treasurer at the time of reapplication for approval of any preliminary plat which has previously been reviewed. A fee in the amount of $100.00 shall be paid by the subdivider for review of a certified survey map. (2008 code § 18.11(2))
17.55.030 Improvement review fee.
The subdivider shall pay a fee or present a bond, certified check, or irrevocable letter of credit of not more than 120 percent of the estimated total cost to complete the required public improvements as estimated by the Town Engineer at the time of the submission of the improvement plans and specifications. The fee may be recomputed, upon demand of the subdivider or Town Engineer, after completion of improvement construction in accordance with the actual cost of such improvements and the difference, if any, shall be paid by or remitted to the subdivider. Evidence of cost shall be in such detail and form as required by the Town Engineer. Any additional monies due the Town shall be paid within 30 days of being issued an invoice for such payment, or in conjunction with the applicant’s request for final Town approval. Fees under this section are limited by the provisions of ETMC 17.15.040. (Ord. 2016-2 § 1. 2008 code § 18.11(3))
17.55.040 Inspection fee.
The subdivider shall pay to the Town Treasurer $100.00 or, if greater, a fee equal to the actual cost to the Town for such inspections as the Town Engineer deems necessary to assure that the construction of the required improvements is in compliance with the plans, specifications and ordinances of the Town. 17.55.050 Final plat review fee.
The subdivider shall pay a fee in the amount of $100.00 plus $10.00 for each lot or parcel within the final plat to the Town Treasurer at the time of first application for final plat approval to assist in defraying the cost of processing. A reapplication fee in the amount of $30.00 shall be paid to the Town Treasurer at the time of a reapplication for approval of any final plat which has previously been reviewed. 17.55.060 Impact fees.
All “land development” within the Town of East Troy “service area” as identified in Chapter 17.60 ETMC is subject to the fees referred to in that impact fee ordinance. (Ord. 2016-2 § 1. 2008 code § 18.11(6))
17.55.070 Engineering fee.
The subdivider shall pay to the Town Treasurer $200.00 or, if greater, a fee equal to the actual cost to the Town for all engineering work incurred by the Town in connection with the plat. In addition:
1. Engineering work shall include the preparation of construction plans and standard specifications. The Town Engineer may permit the subdivider to furnish all or part of the required construction plans and specifications, in which case no engineering fees shall be levied for such plans and specifications.
2. Fees for inspection, checking and reviewing work shall be required as provided in ETMC 17.55.030 and 17.55.040. (2008 code § 18.11(7))
17.55.080 Administrative fee.
The subdivider shall pay to the Town Treasurer $100.00 or, if greater, a fee equal to the cost of any legal, administrative, or fiscal work undertaken by the Town in connection with the plat or certified survey map. Legal work shall include the drafting of contracts between the Town and subdivider. These fees may also include the cost of obtaining professional opinions from attorneys, engineers, landscape architects, land planners, and other professionals, as requested by the Town Board or Plan Commission in connection with the land division being considered.
1. Applicability. This chapter shall be applicable to the following:
a. All applications for certified survey maps which require public or private streets or public utilities, all subdivisions of land as defined by Wis. Stat. Ch. 236, all condominium, planned residential developments and planned unit developments.
b. Any application for the rezoning of land for a conditional use permit.
c. All site plan review as required under the Walworth County General Zoning and Shoreland/Flood Plain Zoning ordinance and the Town of East Troy Municipal Code, and related sections.
2. Recoverable Costs. All recoverable costs which shall be considered as a part of the application fee shall include the following:
a. Legal publication costs.
b. Court reporter costs, recording, or other such costs if deemed required by either the Town Planning Commission or the Town Board.
c. Document preparation review.
d. All professional and technical consultant services retained by the Town of East Troy and rendered in review of the application including, but not limited to, the Town of East Troy’s Engineer, Planner, and Department of Public Works Chief.
e. Legal review, consultation, and advice by the Town Attorney.
f. Copy reproduction.
g. Document recordation (if required).
h. Inspection fees.
3. Condition of All Applications, Approvals and Permits. Reserved.
4. Application Fees. The initial application fee schedule shall be as follows:
a. Preliminary plat review fee: $250.00 plus $25.00 per lot.
b. Final subdivision plat review fee: $100.00 plus $20.00 per lot.
c. Certified survey map review fee: $100.00.
d. Inspection fee: $50.00.
e. Engineering fee: $200.00.
f. Administrative fee: $200.00.
