1.01.010 Adoption, amendment and repeal.

(a) There is hereby adopted the Wheatland Municipal Code which consists of the ordinances of the town that have ongoing effect and which have not expired according to their own terms.

(b) This code may be cited as the Wheatland Municipal Code.

(c) New ordinances may be added to the code, and if an ordinance is enacted with a numbering system that is inconsistent with the code numbering system, the town clerk is authorized to assign an appropriate code number and to codify the ordinance accordingly.

(d) The repeal of any code section does not revive the original text of the code section, but rather, repeal of an existing section repeals the underlying ordinance section and all of its amendments.

(e) No annexation or property zoning ordinances are affected by this recodification.

(f) In the event there is a discrepancy between any provisions of the Wheatland Municipal Code and the underlying ordinance, the provisions in the underlying ordinance control.

(g) This code consists of all the regulatory and penal ordinances and certain of the administrative ordinances of the town of Wheatland, Wyoming, codified by Code Publishing Company, Seattle, Washington, pursuant to the provisions of WS 15-1-103(a)(xxxviii). [Ord. 809 § 1, 2017.]

1.01.020 Repeal of ordinances not included.

The provisions of the above-described Wheatland Municipal Code shall be in force and effect upon its adoption and posting as required by law. [Ord. 809 § 2, 2017.]

1.01.030 Effect of code on past actions and obligations.

The repeal provided for in WMC 1.01.020 shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the adoption of the Wheatland Municipal Code; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the town or authorizing the issue of any bonds of the town, or any evidence of the town’s indebtedness, or any contract or obligation assumed by the town; nor shall such repeal affect the administrative ordinances or resolutions of the town council not in conflict with the Wheatland Municipal Code; nor shall it affect the annual tax levy, nor shall it affect any right or franchise conferred by ordinance or resolution on any person or corporation; nor shall it affect any ordinance relating to the salaries of town officers or employees; nor shall it affect any ordinance naming, opening, accepting or vacating streets or alleys in the town; nor shall it affect any ordinance or resolution establishing or amending rates or fees charged for town services, unless included in the Wheatland Municipal Code. 1.01.040 Reference applies to all amendments.

Whenever a reference is made to this code as the “Wheatland Municipal Code” or to any portion thereof, or to any ordinance of the town of Wheatland, Wyoming, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made. [Ord. 809 § 4, 2017.]

1.01.050 Title, chapter and section headings.

Title, chapter and section headings contained in this code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section hereof. [Ord. 809 § 5, 2017.]

1.01.060 Constitutionality.

If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code. The council declares that it would have passed this code, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases had been declared invalid or unconstitutional, and if for any reason this code should be declared invalid or unconstitutional, then the original ordinance or ordinances shall be in full force and effect. 1.01.070 Reference to specific ordinances.

The provisions of this code shall not in any manner affect matters of record which refer to or are otherwise connected with ordinances which are therein specifically designated by number, or otherwise, and which are included within the code, but such reference shall be construed to apply to the corresponding provisions contained within this code. 1.01.080 Codified ordinances.

The last ordinance included in this codification of the Wheatland Municipal Code is Ordinance No. 807, 2017, approved on January 9, 2017. Ordinances approved by the governing body subsequent to Ordinance No. 807, 2017, but prior to adoption of this code, are hereby adopted and made a part of this code. [Ord. 809 § 8, 2017.]
