13.16.010 Public sewer deemed available when.
For the purposes of this chapter a public sewer shall be deemed to be available to a building if said sewer is installed in a public right-of-way or easement adjacent to the lot upon which said building is located. (Ord. 648 § 1 (part), 1982)
13.16.020 Cesspools declared nuisance Connection to public sewer required when sewer deemed available.
Pursuant to authority of the Health and Safety Code, Section 4762, the city council hereby finds and declares the maintenance or use of cesspools and other local means of sewage disposal within the city to constitute a public nuisance, and finds it to be in the public interest that properties to which a public sewer is available be required to connect thereto. 13.16.030 Connection required when—Private system abandoned—Exceptions.
When a public sewer becomes available to a building served by a private sewage disposal system, said building shall be connected to the public sewer within ninety calendar-days after said public sewer is available and said private disposal system shall be abandoned as provided in Section 13.16.060, unless a variance is granted by the director. 13.16.040 Newly-constructed buildings connected prior to occupancy.
Any newly-constructed building to which a public sewer is available shall be connected to said public sewer prior to its use for human occupancy. (Ord. 648 § 1 (part), 1982)
13.16.050 Variances.
Variances referred to in Section 13.16.030 may be granted upon written application to the director of public works and building official by the applicant setting forth the basis for such request. Variances may be granted only upon affirmative showing that no health hazard, public nuisance, or inequity to other property owners shall result therefrom. (Ord. 648 § 1 (part), 1982)
13.16.060 Abandoned septic tanks required to be filled—Procedure.
A. Where septic tanks are abandoned as a result of connecting any building with the public sewer, the owner of the property to which connection is made shall fill all abandoned septic tanks within thirty days from the time of connecting to the public sewer, in the following manner:
1. All sewage shall be removed from the septic tank.
2. Inlet and outlet pipes shall be disconnected from the tank.
3. All wooden materials forming the top of the tank shall be removed.
4. The tank shall be backfilled and compacted with sand, gravel or concrete, but such filling shall not extend above the vertical sidewalls until inspected by the public works.
5. Following inspection, the tank shall be filled and compacted to the level of the top of the ground. (Ord. 648 § 1 (part), 1982)
