8.28.010 TRUCK DEFINED:

For purposes of this chapter, the word "truck" means any commercial vehicle exceeding a maximum gross weight of three (3) tons; subject however, to the exceptions set forth in section 8.28.040 of this chapter. (1972 Code § 10.32.010)

8.28.020 TRUCK ROUTES ESTABLISHED:

A.    Streets Designated: The following streets within the city are established as authorized truck routes:

1.    All of Alta Street; and

2.    That portion of Gonzales River Road situated in the city limits.

B.    Posting Of Signs: The chief of police shall cause signs to be posted indicating such streets or portions of streets to be truck routes for the use of vehicles exceeding a maximum gross weight of three (3) tons. (1972 Code § 10.32.020; amd. Ord. 2019-113, 6-17-2019)

8.28.030 TRUCK TRAFFIC LIMITED TO DESIGNATED ROUTES:

When authorized signs are posted giving notice of designated truck routes, no person shall operate, drive, or cause or permit to be operated or driven, a "truck" (as defined in section 8.28.010 of this chapter) on any street within the city which is not a designated truck route, except as otherwise provided in section 8.28.040 of this chapter. 8.28.040 CERTAIN VEHICLES EXCEPTED:

The provisions of this chapter shall not apply to any of the following:

A.    Passenger buses subject to California Vehicle Code sections 1031 to 1036, inclusive.

B.    Any authorized emergency vehicle, as defined in California Vehicle Code section 165.

C.    Any vehicle owned, leased, operated or controlled by any of the following:

1.    A government agency;

2.    A public utility or a licensed contractor, while necessarily in use in the construction, installation or repair of any public utility property or facility; and

3.    The holder of a franchise issued by the city for the removal of garbage, waste or refuse, or the operator of a waste materials recycling program approved or authorized by the city.

D.    Any vehicle making pick ups or deliveries of goods, wares and merchandise from or to a building or structure located on a restricted street, or delivering materials to be used in the actual and bona fide repair, alteration, remodeling, construction or reconstruction of any building or structure located upon on a restricted street. 8.28.050 WEIGHING OF VEHICLES; CITY AUTHORITY:

Any peace officer having jurisdiction within the city or acting under its authority may require any person driving or in control of any "truck" (as defined in section 8.28.010 of this chapter) on a street that is not established as a designated truck route by section 8.28.020 of this chapter, to proceed to any public or private scale available for the weighing of vehicles for the purpose of determining whether the provisions of this chapter have been violated. 8.28.060 PARKING OF TRUCKS OFF TRUCK ROUTE:

The parking of any truck on a street that is not a designated truck route is prohibited. The city council may from time to time, by resolution, impose parking restrictions on streets that are designated as a truck route, as in its discretion it shall deem necessary. (1972 Code § 10.32.060)
