5.60.010 Permit to sell water within city.
It is unlawful for any person to carry on the business of the sale of water at retail within the municipal limits of the city, or to contract for the sale, sell or offer to sell water at retail to any of the inhabitants of the city for use within the city, whether the sale, or offering for sale, is through an existing or established system, or an improvement, enlargement or replacement thereof or addition thereto, or a new system, unless a permit first has been issued to do so. 5.60.020 Permit to establish water system.
It is unlawful for any person to lay any pipes, pipe lines, or fittings within the city for the purpose of establishing a water system, or for the purpose of improving, enlarging or replacing any portion of an established and existing water system, and the sale of water at retail to inhabitants of the city for use within the municipality, unless a permit first has been issued to do so. (Prior code § 29.9).
5.60.030 Application for permits.
Any person who for any reason desires to operate a water system, or in the operation to improve, replace or enlarge an existing water system within the city and install pipes, pipe lines and fittings, and sell water to the inhabitants of the city for use therein, shall, prior to so doing, make a written application to the City Council for permission to do so, describing the property sought to be served, the property and streets over which it seeks to install its pipes and pipe lines, the size and character of its pipes and pipe lines, the size and location of fire hydrants, the minimum water pressure to be maintained at all times, the approximate number of consumers sought to be served, the object and purpose of installing such a water system, and a true and correct financial statement of its condition as of the date of filing the application. 5.60.040 Application approval—Public hearing by City Council.
Upon receipt of an application as required by the preceding section, the City Council shall consider the same and either grant or deny the application either with, or without, a public hearing on the application. The requirement of a hearing on the application shall be within the discretion of the council. If a hearing is directed to be had by the council, notice thereof shall be given, at least ten days prior to the hearing, by one publication in a newspaper, printed, published and circulated within the city and at the hearing any person interested therein may be heard prior to action taken on the application by the council.
