17.46.010 Required.

All utility distribution facilities (including, but not limited to, electric, communication and cable television lines) installed in and for the purpose of supplying service to any single-family and/or multifamily residential subdivision of five or more lots, or to any commercial subdivision, shall be placed underground with the exception of poles or electroliers used exclusively for street lighting. (Ord. 278 § 1, 1969)

17.46.020 Exceptions authorized.

The City Council may authorize either or both of the following exceptions to the provision in MSMC 17.46.010:

(A) Equipment appurtenant to underground facilities, such as surface-mounted transformers, pedestal-mounted terminal boxes and meter cabinets, and concealed ducts;

(B) Poles supporting only high voltage wires, switches and transformers. (Ord. 278 § 2, 1969)

17.46.030 Subdivider must comply.

The subdivider is responsible for complying with the requirements of this chapter and shall make the necessary arrangements with the utility companies involved for the installation of said facilities. The Mt. Shasta City Council may waive the requirements of this chapter if topographical, soil, or any other conditions make underground installation of said facilities unreasonable or impractical. 17.46.040 Exclusions.

Industrial subdivisions are excluded from the provisions of this chapter. (Ord. 278 § 4, 1969)

17.46.050 Applicability.

This chapter is to apply to residential and commercial subdivisions approved after the effective date of the ordinance codified in this chapter. (Ord. 278 § 5, 1969)

17.46.060 Installation standards.

Installation shall comply to the National Electrical Code and California safety orders as they now stand or with any subsequent changes that may be made and/or new editions to the codes. (Ord. 278 § 6, 1969)

17.46.070 Specifications to accompany permit application.

With each application for a permit to install underground utilities, two sets of plans and specifications shall be approved by a California State licensed engineer. Plans shall delineate location, depth, juncture of lateral lines, easements and any further information required to sufficiently inform the installer and/or for future locating. (Ord. 278 § 7, 1969)

17.46.080 Advisory committee created.

The Council shall establish a technical advisory committee for the sole purpose of studying plans for undergrounding of utilities, prior to action by the Mt. Shasta Planning Commission and the Mt. Shasta City Council, and to submit their recommendation to these bodies. The advisory committee shall consist of the Mt. Shasta City Council, one member of the Mt. Shasta Planning Commission, a representative from the California Division of Highways, and a representative from each of the utility companies serving the City of Mt. Shasta. (Ord. 278 § 8, 1969)

17.46.090 Plan submittal to Commission.

Plans shall be submitted to the Mt. Shasta Planning Commission for approval of conformity to the subdivision and for existing and future use prior to the issuance of a construction permit. (Ord. 278 § 9, 1969)

17.46.100 Permit – Fee – Void when.

A fee of $2.00 shall be collected for the permit. A fee of $2.50 per 1,000 linear feet of installation underground shall be charged for inspection. Permits shall become null and void if the work authorized by such permit is not commenced within 60 days from date of issuance. The Building Official may, in writing, suspend or revoke a permit issued under provisions of this chapter when the permit is issued in error, or on the basis of incorrect information supplied, or in violation of any ordinance or regulation. 17.46.110 Violation – Penalty.
