16.41.010 Purpose.

The purpose of this chapter is to enhance the quality of life of persons residing in residential areas of the city in which streets are congested with vehicles parked by persons not residing in such areas. This chapter limits the parking of vehicles along the streets in such areas to persons residing in such areas. [Ord. 12-021 § 2, 2012; Ord. 1457 N.S. § 1, 1984].

16.41.020 Designation.

(a) The city council may, by resolution, designate an area of the city as a residential parking permit area if the council finds that the area is predominantly residential, that the streets in the area are congested with vehicles parked by persons not residing in the area, and that limiting the parking of vehicles along the streets in the area to vehicles controlled and exclusively used by persons residing in the area is necessary in order to enhance the quality of life of persons residing in the area.

(b) In determining whether limiting the parking of vehicles along the street in an area to persons as described in subsection (a) of this section is necessary in order to enhance the quality of life of persons residing in the area, the council shall consider the effect of vehicles parked by persons not residing in the area on ambient noise levels, air pollution levels and other environmental characteristics of the area; pedestrian and vehicular traffic safety in the area; and the burden on persons residing in the area in gaining access to their residences.

(c) A resolution designating an area as a residential permit parking area shall describe the designated area along which parking will be limited to vehicles controlled and exclusively used by persons residing in the area, and shall set forth the hours and days when parking will be limited to vehicles controlled exclusively by persons residing in the area. 16.41.030 Posting.

Upon adoption of a resolution by the council designating an area as a residential parking permit area, the city shall cause appropriate signs to be erected along the street(s) identified in the resolution which shall give notice of the limitation on the parking of vehicles in the area as provided by PGMC 16.41.040 and shall indicate the hours and days when such limitations shall be in effect. 16.41.040 Limitations on parking.

It is unlawful for any person to stop or park a vehicle on any street identified in a resolution adopted by the council designating a residential permit parking area during the hours and on the days set forth on the resolution, except:

(a) A vehicle controlled and exclusively used by a person residing in the designated residential permit parking area displaying a valid permit issued as provided for by PGMC 16.41.050; or

(b) A vehicle under the control of a visitor to a person as described in subsection (a) of this section displaying a valid visitor permit as provided for by PGMC 16.41.050; or

(c) An emergency vehicle, including, but not limited to, an ambulance, fire engine or police vehicle; or

(d) A vehicle under the control of a person providing service to property located in the designated residential permit parking area, including, but not limited to, a delivery vehicle; or

(e) A vehicle used by a disabled person which displays a disabled person license plate or placard issued by the California Department of Motor Vehicles. [Ord. 12-021 § 2, 2012; Ord. 1457 N.S. § 1, 1984].

16.41.050 Permit.

(a) With the exception of the residential permit parking area on Sloat Avenue and Ocean View Boulevard, between 1st Street and Dewey Avenue, upon the application of any person residing (“resident”) in a residential permit parking area, the city shall issue a parking permit for (1) each vehicle under the control of and exclusively used by such person or other full-time resident at that address, and (2) one visitor permit for use by persons visiting the resident and during said visit parking on a street in the residential permit parking area. Within the residential permit parking area on Sloat Avenue and Ocean View Boulevard, between 1st Street and Dewey Avenue, a maximum of two residential parking permits per residential address may be issued during any calendar year for the exclusive use of the resident and/or persons visiting the resident to whom the permit has been issued. Each resident permit shall be valid for one calendar year. The visitor permit shall identify the residence for which it is issued, shall be valid for one calendar year and may be used on any visitor vehicle at any time during the year.

(b) Applications for permits described in subsection (a) of this section shall be made on a form prescribed by the city, shall be accompanied by proof in a form satisfactory to the city of the residency and use and control of vehicles, and shall be accompanied by a fee as adopted by the council, no part of which shall be refundable to applicant.

(c) Permits shall be displayed in the manner prescribed by the city at the time the permit is issued. [Ord. 12-021 § 2, 2012; Ord. 1457 N.S. § 1, 1984].
