7.2-10 Creation of commission

(a)    Pursuant to the provisions of Welfare and Institutions Code Section 14087.54, the Solano County board of supervisors establishes the Partnership HealthPlan of California (PHC) commission on medical care. PHC is a multicounty commission representing multiple counties as set forth in attached Exhibit “A” and incorporated by reference. Unless otherwise required by state, the county may adopt by resolution, amendments to the member counties of the commission.

(b)    PHC shall continue to represent Solano County until such time as the Solano County board of supervisors takes an affirmative action by ordinance to terminate the commission. Any action to terminate the commission must be preceded by a ninety (90) day notice to the other member counties and the State Department of Health Care Services, as set forth in Section 14087.54(g).

7.2-11 Purpose of commission

The purpose of the commission is to negotiate exclusive contracts with the California State Department of Health Care Services and to arrange for the provision of health care services to the uninsured employed and their families and to qualifying individuals who lack sufficient annual income to meet the cost of health care, and whose other assets are so limited that their application towards the cost of health care would jeopardize the person’s or family’s future minimum self-maintenance and security, all pursuant to Article 2.8, Chapter 7, Part 3, Division IX of the Welfare and Institutions Code.

7.2-12 Membership of commission

(a)    The Partnership HealthPlan of California (PHC) commission on medical care shall be comprised of commissioners appointed by the board of supervisors of each member county. Each county shall have a designated number of commissioners in accordance with a formula adopted by the PHC. The number of Medi-Cal members for each county shall be determined by PHC as of July 1st of each year beginning in the year 2009. The determination by PHC shall be announced to each county by August 1st of each year. Any additions of commissioners shall be implemented effective September 1st of each year. Any deletions shall be accomplished through attrition in accordance with PHC policies.

(b)    The membership of the PHC shall be as set forth in attachment Exhibit “A” and is incorporated by reference. Unless otherwise required by statute, the county may adopt by resolution, amendments to the membership of the Partnership HealthPlan and to the allocation and composition of the commission and commissioners.

7.2-13 Terms of office for members and vacancy in office

The terms of office for each of the members of the policy board shall be four (4) years. The terms of the original members shall be staggered to provide that one-half (1/2) of those original members, including one (1) physician member and one (1) hospital member shall serve a term of two (2) years, and the other half, including two (2) physician members and one (1) hospital member shall serve a term of four (4) years. This will allow for a continuity of policy. Nothing herein shall prohibit a person from serving more than one (1) term.

Each board member shall remain in office, at the conclusion of that member’s term until a successor member has been selected and installed into office.

An office shall become vacant if a board member discontinues to function in the area from which appointed, or fails to attend three (3) meetings in a row of the policy board.

7.2-14 Powers and duties of commission members

The powers and duties of the commission members are to negotiate the exclusive agreement with the California Department of Health Care Services or its successor agency for the provision of health care services provided under Chapter 7, beginning with Welfare and Institutions Code Section 14000, and to arrange for the provision of those services.

7.2-15 Committees

(a)    The commission may establish advisory committees from time to time for any purpose that will be beneficial in accomplishing the work of the commission.

(b)    Any advisory committee established pursuant to this section shall consist of a minimum of three members, one from each participating county.

(c)    At a minimum, the Commission shall establish the following two advisory committees:

(1)    A Physicians Advisory Committee which shall consist of one physician from each participating county.

(2)    A Consumers Advisory Committee which shall consist of at least one health care consumer from each participating county.

Note: Partnership will have 3 – At-large Consumer Representatives on the Board as of January 1, 2024 (1 – Northern Region and 1 – Southern Region and 1 – Eastern Region). Consumer seats have 2-year terms.

3.    Solano County Commissioners

The commissioners shall be selected from the following categories, with no more than one representative from any category below with special efforts to select candidates, as opportunity allows, who reflect the diversity of the community:

•    The County Director of the Health and Social Services Department

•    Representative from a community health clinic

•    Physician

•    Representative from the Solano County Hospitals (Kaiser Permanente, Sutter Solano and North Bay Medical Center) on a rotating basis.
