§4110 UNLAWFUL TO ALLOW CERTAIN ANIMALS TO RUN AT LARGE
It shall be unlawful for the owner or keeper of any horse, mule, sheep, goat, hog, cow, or cattle of any kind, to allow the same, or any of them, to run at large within the limits of the City, or to be herded, picketed upon, staked out or grazed upon any public street, park, or other public grounds of said City. §4111 DUTY OF POUNDMASTER TO IMPOUND ANIMALS
It shall be the duty of the Poundmaster to take up and impound every animal mentioned in §4110, or any of them, running at large in the City, or herded, picketed upon, staked out, or grazed upon any public street, sidewalk, square, park or other public ground in said City, and notify the owner, or keeper thereof immediately, if known to him. §4112 SALE OF UNCLAIMED ANIMALS AT AUCTION
After three (3) days from such impounding, the Poundmaster shall post for five (5) days a notice in three (3) public places in the City that he will sell the animals at public auction to the highest bidder for cash, giving therein a description of such animal, or animals, and the time and place of such sale, at which time, or the time to which he may adjourn such sale, which shall be not more than fifteen (15) days from the time of posting the said notices, he shall sell the same in accordance therewith, and pay the money arising therefrom to the Director of Finance; or may pay the Poundmaster the charges provided in §4113 and take such animal or animals away. §4113 CHARGES FOR TAKING UP AND KEEPING
The owner or keeper of any impounded animal shall pay to the Director of Finance the following charges before receiving any impounded animal:
A. For taking up and impounding, each animal one dollar ($1.00) per day:
B. For feeding each animal, fifty cents ($0.50) per day;
C. For posting notices of sale, fifty cents ($0.50) for each animal. (Ord. 178, §3, adopted 1909)
§4114 ANIMALS TO BE DESTROYED
All animals so taken into the custody of the Poundmaster which, by reason of age or disease or other cause, are unfit for further use or dangerous to keep impounded or for which no bid is made when exposed to public sale as in this Article provided, shall forthwith be destroyed by the Poundmaster. §4115 ANY PERSON MAY TAKE UP ANIMALS
Any person may take up and deliver to the Poundmaster any animal which the Poundmaster is, by this Article, required to impound. (Ord. 178, §5, adopted 1909)
§4116 ANY TRESPASSING ANIMAL MAY BE TAKEN UP
Any animal found trespassing on any private enclosure in the City may be taken up by any person and delivered to the Poundmaster. (Ord. 178, §6, adopted 1909)
§4117 UNLAWFUL TO OBSTRUCT POUNDMASTER
It shall be unlawful for any person to resist or obstruct the Poundmaster in the performance of his duties as such, or to take or remove from the pound any animal or animals without the permission of the Poundmaster. (Ord. 178, §7, adopted 1909)
§4118 PENALTY FOR VIOLATION
Any person violating any of the provisions of this Article shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not less than five dollars ($5.00) nor more than fifty dollars ($50.00), or by imprisonment of not more than twenty five (25) days, or by both such fine and imprisonment.
