(a) Purpose. The purpose of this section is to authorize the town code enforcement officer to assist the building and fire officials in a limited capacity in the regulation of town building permits and enforcement of the town building codes adopted in Chapter 15.05 GMC.

(b) Authority of Code Enforcement Officer to Assist Building or Fire Enforcement Official. The town code enforcement officer is authorized to assist the building or fire official to facilitate enforcement of the town’s adopted building codes set forth in Chapter 15.05 GMC.

The town code enforcement officer may assist by issuing code violation notices, verbal or written warnings, summons or complaints or legal notification or action as directed in writing by the town, building, or fire official. The town’s code enforcement officer may provide documentation, observations, evidence or information relating to possible violations of Chapter 15.05 GMC, Building Codes, to the building or fire official for investigation and enforcement.

(c) Authority of Code Enforcement Officer to Enforce Specific Building Code and Construction Site Violations and Conduct Inspections.

(1) The town code enforcement officer is authorized to make limited inspections of property to determine compliance with subsection (c)(2) of this section. In the event the code enforcement officer determines there is a violation of this section, the code enforcement officer may issue a written warning. If such violation continues after the date as designated in the written warning, the code enforcement officer may issue a summons and complaint including a verification of violation from the building or fire official.

(2) Building code and construction site violations to enforce:

(i) Premises Identification. As provided for in any town adopted building code, buildings shall have approved address numbers, building numbers and/or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. Where access is by means of a private road and the building address cannot be viewed from the public way, a monument, pole or other sign or means shall be used to identify the structure.

(ii) Inspection Record Card or Building Permit. As provided for in any town adopted building code, work requiring a building permit shall not commence until the permit holder or permit holder’s agent has posted an inspection record card in a conspicuous place on the premises and in a position as to allow the building official to make the required entries thereon regarding inspection of the work. This card or permit shall be maintained in such a position by the permit holder until all inspections have been made and final approvals have been granted by the building official.

(iii) Emergency Vehicle Access. During active construction, no person may park a vehicle in a manner that obstructs, restricts access to, or blocks the path of any emergency services vehicle.

(iv) Construction Dumpsters. During construction all dumpsters shall be placed on property and not in the street, alley or roadway or in any manner as to interfere with traffic or emergency services vehicles.

(v) Excavation permits, including permits and the terms and conditions contained therein required pursuant to Chapters 12.05 and 15.11 GMC.

(3) Penalties. Any person who violates any of the building code violations as described in subsection (c)(2) of this section shall be deemed guilty of a municipal ordinance violation, and upon conviction hereof, may be fined not more than the maximum penalty set forth in GMC 1.05.090.
