1-8-1 POLICE DEPARTMENT ESTABLISHED, PERSONNEL:

There is hereby created and established a police department of the city of Garden City. Said department shall consist of a chief of police and such subordinate officers as shall be authorized from time to time by the mayor and city council. (Ord. 64, 4-8-1954)

1-8-2 APPOINTMENT AND TERMS OF OFFICERS AND MEMBERS:

A.    The mayor shall appoint, with the consent of the council, a chief of police, according to the provisions of section 1-6-1 of this title.

B.    All subordinate police officers shall be hired and dismissed by the chief of police. Any subordinate officer who has been dismissed may request in writing that a hearing be held before the council to show cause why he should not be dismissed and the council shall, within five (5) days of the filing of such request, hold a hearing to affirm or disaffirm his dismissal. C.    All subordinate officers may be dismissed at any time by the chief of police, and the subordinate officer may, if he so desires and within ten (10) days from the date of his dismissal, request a hearing before the city council to show cause why he should not be dismissed, and the city council shall, within ten (10) days of the filing of the request for hearing by the subordinate officer, affirm or disaffirm his dismissal. 1-8-3 POWERS AND DUTIES:

A.    General Powers: The officers and members of the police department shall have power to arrest all offenders against the law of the state or of the city by day or by night, in the same manner as other police officers of the state, and keep them in jail or other place to prevent their escape until trial can be had before the proper officer. They shall likewise be vested with power to serve any other process issued under authority of the ordinances of the city. (Ord. 64, 4-8-1954)

B.    Call For Assistance, Refusal To Assist: The chief of police or any member of the police department shall have authority to call upon any person to assist him in making any arrest or in capturing or retaining in custody any person. Any person so requested who shall refuse or fail, to the best of his ability, to render such aid as required shall be guilty of an infraction, and upon conviction thereof shall be punished as provided in section 1-4-1 of this title. C.    Special Police: Special police may be appointed and upon appointment shall be assigned to such functions, area of operation, duties and powers of police as may be designated by the chief of police. Such special police shall not be deemed as being within the provisions of the civil service rules and regulations and shall be subject to dismissal at any time. Special police shall act without pay unless otherwise provided by the mayor and council. (Ord. 700, 2-10-1998)

D.    1. Appointment Of Volunteer Code Enforcement Officers: The chief of police is authorized to appoint volunteer code enforcement officers to issue parking violation citations for all violations of section 5-1-4 of this code, and to issue notice of, and citations for, all violations of title 4, chapter 3 of this code, for the abatement of nuisances. Volunteers appointed under this section and chapter must be at least twenty one (21) years of age and a resident of Ada County.

The chief of police appointing the volunteers may establish any other qualifications deemed desirable and necessary.

2. Authority Of Volunteer Code Enforcement Officers: Volunteer code enforcement officers commissioned by the city of Garden City are empowered to enter public property or private property open to public use, to enforce all the provisions of title 4, chapter 3 and section 5-1-4 of this code, and are empowered to check personal identification to determine if the user of a special license plate or placard is authorized to use an accessible handicapped parking space.

3. Training Of Volunteer Code Enforcement Officers: Upon appointment of volunteer code enforcement officers by the chief of police under this chapter and section, the volunteers shall be provided training before being authorized to issue warnings or citations for parking violations and/or nuisance violations.

4. Force And Effect: Any parking or nuisance abatement violation notice or citation issued by a volunteer code enforcement officer appointed under this section shall have the same force and effect as a notice or citation issued by a city of Garden City police officer for the same offense. Volunteer code enforcement officers shall not be authorized to impound any vehicle. (1988 Code)

1-8-4 POLICE TRAINING AID:

The city declares that it desires to qualify to receive aid for police training from the Idaho police officers’ standards and training council pursuant to Idaho Code sections 19-5101 et seq., and while receiving such aid will adhere to the standards for recruitment and training established by that council. 1-8-5 RESERVE POLICE OFFICER RESTRICTIONS:

No person who is related to an employee or official within the second degree of consanguinity or affinity shall be enrolled, appointed or allowed to serve as a reserve officer of the city police department. It shall be unlawful for any official of the Garden City police department to appoint a prohibited person as a reserve officer of the police department, and any person so doing shall be punished as provided in section 1-4-1 of this title. Further, the official so appointed shall be removed from office. (Ord. 417, 8-26-1980; amd. 1988 Code)

1-8-6 COMPENSATION:

The compensation of officers and members of the police department shall be such as shall be fixed by the mayor and city council. (Ord. 64, 4-8-1954)

1-8-7 POLICY AND PROCEDURES MANUAL:

The chief of police shall provide to each employee of the department a written policy and procedures manual containing departmental rules and regulations. This manual shall conform to all local, state and federal regulations and shall be updated periodically as required. All departmental employees shall read the policy and procedures manual and acknowledge receipt for the manual and updates. (As recognized by the Garden City council on 4-4-1987)
