FOREIGN FIRE INSURANCE COMPANIES

5-50-070 Officers, quorum, special meetings.
5-50-010 Short title.
This chapter shall be known as and may be cited as “Foreign Fire Insurance Companies” in the city. (Ord. 2870 § 1 (part), 1994)
5-50-020 Board established.
There is established a foreign fire insurance board. (Ord. 2870 § 1 (part), 1994)
5-50-030 Definitions.
For the purposes of this chapter, whenever any of the following words, or terms are used, they shall have the meanings ascribed to them in this section:
“Board” means the foreign fire insurance board.
“Department” means the city fire department.
“Fund” means foreign fire insurance tax fund.
“Members of the department” means any sworn personnel currently employed by the city fire department.
“Temporary election committee” means city fire department election committee. (Ord. 2870 § 1 (part), 1944)
5-50-040 Election of members.
A. The foreign insurance board shall consist of four members.
B. The members of the city fire department shall elect four (4) officers who shall serve as the members of the board. The chief of the fire department shall be the ex officio fifth member of said board. Two (2) of the elected members shall be members of the firefighter’s union, and two members shall be elected from fire department management.
C. The members of the department shall elect the following officers: (1) chairman; (2) vice chairman; (3) secretary; and (4) treasurer.
D. Members of the board shall serve two-year terms and until their successors are elected and installed; provided, however, that two of the initial appointees shall serve two-year terms and two of the initial appointees shall serve one-year terms. The initial terms of office of the members of the board shall begin on _______________________ and expire on _______________________.
E. Vacancies shall be filled by election by the members of the department for the balance of the unexpired term. (Ord. 2870 § 1 (part), 1994)
5-50-050 Election procedure.
A. There is established a temporary city fire department election committee. The temporary election committee shall consist of three members. The chief of the city fire department shall serve ex officio as chairman of the committee. The chief shall appoint two members of the department to serve on the committee, one member of which shall be from the classified ranks.
B. The temporary election committee shall be responsible for organizing, conducting and supervising the initial election of department officers to serve on the board. Thereafter, the board shall establish election procedures consistent with this chapter.
C. The board shall develop a procedure for governing the nomination of members to run for the various offices to serve on the board. The nominating procedure shall be established a minimum of thirty (30) days prior to the expiration of the board members’ terms of office.
D. The board shall develop a procedure for the final election of members to the various offices on the board. The final election procedure shall be established a minimum of thirty (30) days prior to the expiration of the board members’ terms of office.
E. The board may adopt rules and regulations governing the election of officers of the board. All rules and regulations with respect to the election process shall be posted throughout the department a minimum of thirty (30) days prior to the election. (Ord. 2870 § 1 (part), 1994)
5-50-060 Fund established.
A. All funds received by the city from the foreign fire insurance gross receipts tax shall be deposited in a special fund within the city treasury called the “foreign fire insurance tax fund.”
B. The city treasurer shall provide the treasurer of the board a biannual accounting of receipts.
C. No expenditure shall be made from the fund without the approval of the board.
D. The treasurer of the board shall give sufficient bond to the city. The bond shall be approved by the mayor.
E. The treasurer of the foreign fire insurance board shall make semiannual reports to the city council of all receipts and expenditures of said fund. (Ord. 2870 § 1 (part), 1994)
5-50-070 Officers, quorum, special meetings.
The board shall, in accordance with the Open Meetings Act, establish a regular time and place for its meetings. The chairman shall preside at the meetings. The secretary shall keep a record of all resolutions, proceedings and actions of the board and these records shall be open to the public. Three members of the board shall constitute a quorum for the transaction of its business. The affirmative vote of three members of the board shall constitute approval of business before it. Special meetings may be called by the chairman or by no less than three members of the board. Any person shall be entitled to appear and be heard on any matter before the board. 5-50-080 Powers and duties.
A. The board shall have the power to approve the expenditure of monies from the fund for the maintenance, use and benefit of the department.
B. The board may adopt rules and regulations for governing the board and the execution of the duties of the board, and provide for election of the board and management of the fund.
C. The board may amend or revoke rules and regulations so adopted. (Ord. 2870 § 1 (part), 1994)
