FRUIT, VEGETABLE AND GROCERY STORES

5-52-010 Definitions.
As used in this chapter
“Fruit and vegetable store” shall be construed to mean any establishment for the retail sale of fresh fruits, berries or vegetables not produced on the premises.
“Grocery store” shall be construed to mean any establishment for the sale at retail of butter, cheese, vegetables or other provisions. (Prior code § 5-41-1)
5-52-020 License required.
No person shall operate or conduct a fruit and vegetable store or grocery store without first having obtained a license therefor. Applications for such license shall be made to the clerk and it shall be his duty to refer such application to the health officer. It shall be the duty of the health officer to investigate the premises on which it is intended to conduct the store, and to report as to his findings. No license shall be issued to conduct a fruit and vegetable store in any building or premises maintained in an unsanitary or unhealthful condition. (Prior code § 5-41-2)
5-52-030 Fee.
The annual fee for such license shall be as laid out in Chapter 3-01, Fees, Fines, Insurance and Guarantee Requirements, and no such license shall be issued except on payment of the fee. (Ord. 3494 § 2(B), 2024; prior code § 5-41-3)
5-52-040 Sanitation.
It shall be the duty of every person operating a fruit and vegetable store, or grocery store, to keep and maintain the same in a sanitary condition, and no foods shall be kept in open shelves or display cases nor exposed less than eighteen (18) inches above the floor. (Prior code § 5-41-4)
