5-54-010 Personal property sales—Prohibition generally.
It is unlawful to do business in the city in any established area wherein personal property is being sold under the guise of garage sales, porch sales, basement sales and other yard sales of a similar nature which tends to disturb and disrupt the residential environment of the area. 5-54-020 Permit—Required.
Any person who desires to hold a personal property sale as stated in Section 5-54-010 shall first obtain a permit for such purpose from the building department of the city. (Ord. 2005 § 2, 1974)
5-54-030 Permit—Term.
Any such permit issued for such purpose shall be limited to a term not exceeding three calendar days running consecutively in each year per residential dwelling. (Ord. 2005 § 3, 1974)
5-54-040 Permit—Exemptions designated.
Said requirement does not apply to nonprofit clubs or organizations situated in the city. (Ord. 2005 § 4, 1974)
5-54-050 Permit—Fee.
The permit shall be secured from the planning department of the city upon forms prescribed by them and the fee for such permit shall be as laid out in Chapter 3-01, Fees, Fines, Insurance and Guarantee Requirements. (Ord. 3494 § 2(B), 2024; Ord. 3316 § 2 (part), 2015: Ord. 2005 § 5, 1974)
5-54-060 Rights of city officers.
Any officer of the city shall have the right to enter and inspect any premises which advertise any sale of personal property and shall have the right to arrest any person who violates the provisions of this chapter. (Ord. 2005 § 6, 1974)
