5-58-010 License required.
It is unlawful to conduct or operate a hotel without first having obtained a license therefor. (Prior code § 5-29-1)
5-58-020 Application.
Applications for such licenses shall be made in writing and shall comply with the provisions of this code relative to applications for licenses generally; and each application shall contain, in addition to other information, a statement of the number of rooms for the use of guests, exclusive of rooms used by all guests for dining, library or other general purposes. 5-58-030 Fee.
The annual fee for a hotel license shall be as laid out in Chapter 3-01, Fees, Fines, Insurance and Guarantee Requirements. (Ord. 3494 § 2(B), 2024; Ord. 3316 § 2 (part), 2015: Ord. 1921 (part), 1972; prior code § 5-29-3)
5-58-040 Sanitary requirements.
Each hotel in the city shall be kept in a clean and sanitary condition, free from rodents and vermin. The health inspector shall cause each hotel to be inspected as often as may be necessary to insure the clean condition thereof. (Prior code § 5-29-4)
5-58-050 Police department access—Required.
The hotel register shall be open to inspection by any member of the police department at all times, and the members of the police department shall have access at all times to all rooms open to the public or to guests generally. (Prior code § 5-29-5)
5-58-060 Hourly rentals.
No owner, operator, keeper or proprietor of a hotel shall provide lodging at an hourly rate or advertise an hourly rate for lodging. (Ord. 3488 § 3, 2024)
5-58-070 Limitation of occupancy.
No owner, operator, keeper or proprietor of a hotel shall rent, let, register or otherwise allow the use of any hotel room more than one (1) time within a period of eight (8) consecutive hours, and no hotel room may be let, rented or registered for less than a period of eight (8) consecutive hours. 5-58-080 Maximum stay length.
A. No hotel within the city shall allow any person to occupy such facility for more than fourteen (14) consecutive days without first obtaining a specific extended stay hotel license. No guest residing for more than fourteen (14) consecutive days shall begin a new rental agreement with a hotel that does not have an extended stay hotel license without at least a two (2) day vacancy between stays.
B. Upon application, pursuant to Section 5-58-020, approval for an extended stay hotel license as part of the hotel operator’s license application and renewal may be granted and shall set specific parameters to the length of any permitted hotel stays in excess of two (2) consecutive weeks. In no event shall an extended stay hotel provide accommodation in excess of six (6) consecutive months. (Ord. 3488 § 3, 2024)
5-58-090 Responsibilities of all hotels.
A. Every owner, operator, keeper or proprietor of any hotel shall, without delay, report violations of law to the city of Harvey police department that were either witnessed or made known to them by an employee, guest, visitor or other person on the premises.
B. Every owner, operator, keeper or proprietor of any hotel shall, at all times, maintain a manager on duty or on-call capable of assisting, communicating, and cooperating with the police or other law enforcement officials in maintaining the public health, welfare, and safety. (Ord. 3488 § 3, 2024)
5-58-100 Penalties.
A. A violation of this chapter shall be subject to a fine as laid out in Chapter 3-01, Fees, Fines, Insurance and Guarantee Requirements. Each day that a violation continues shall constitute a separate and distinct offense.
B. In addition to any other penalties imposed by law, a violation of this chapter may result in the suspension or revocation of the license hereunder. (Ord. 3494 § 2(B), 2024; Ord. 3488 § 3, 2024)
