AUTOMOBILE AND TRUCK RELATED USES

16-38-005 Special uses.
All automobile and truck related use applications are special uses and conditional on approval by the plan commission and the city council as in the HC and LM districts as defined in Sections 16-32-040 and 16-36-040 of this code. (Ord. 3445 § 5, 2021)
16-38-010 Site plan review required.
All applications for special use applications for automobile and truck related uses shall require a site plan review as defined in Section 16-04-370 of this code. (Ord. 3445 § 5, 2021)
16-38-020 Site development standards for automobile and truck related uses.
A. Surfacing. All premises approved for automobile and truck related uses shall be improved with permanent, durable and dustless surfaces and shall be graded and drained so as to dispose of all surface water without detriment to surrounding uses. All unpaved surfaces shall be sod and adequately landscaped; and
B. Open spaces not permitted to be used for buildings, parking, walking, drives and other authorized impervious surfaces shall be open to the sky and planted with trees, shrubbery, and grass; and
C. Screening. All screening must comply with the requirements as established in Section 16-72-150 of this code; and
D. Signage. All sign plans must comply with Chapter 16-64 of this code.
1. Prohibited Signs.
a. Signs that move in any manner or have a major moving part;
b. Signs that may swing or otherwise noticeably move due to wind or appear to be moving or flickering as a result of optical illusion;
c. Signs that advertise an activity, business, product or service no longer conducted on the premises upon which the sign is located;
d. Portable signs being used for uses other than a temporary nature;
e. Permanent signs which are abandoned and/or obsolete, as defined in Section 16-64-040(F) of this code, for a period of not less than ninety (90) days;
f. Any illumination of signs on a property in which the business is no longer operational due to their business license being withheld or denied, or revoked due to nuisance;
g. Pole signs (freestanding signs mounted on a pole; and
E. Lighting used to illuminate any outdoor sales area, off-street parking, or loading areas shall be arranged to reflect the light away from adjoining premises in compliance with Section 16-72-120 of this code; and
F. Bulk Space, Setback and Yard Regulations. The bulk, space, setback and yard regulations for automobile and truck related uses are as follows:

G. The chairman of the planning and zoning commission may require any such additional information from any applicant which is reasonably intended to achieve full disclosure relevant to their associated application under consideration by the planning and zoning commission. (Ord. 3445 § 5, 2021)
