10.20.010 Pedestrians subject to traffic-control signals.

Pedestrians shall be subject to traffic-control signals as set forth in EMC 10.05.100 through 10.05.150. At all other places pedestrians shall be granted those rights and be subject to the restrictions stated in this chapter. [1962 Code § 351.01; 1982 Code § 73.01; 1983 Code § 7.73.01.]

10.20.020 Right-of-way in crosswalks.

(A) When traffic-control signals are not in place or not in operation, the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when the pedestrian is on the half of the roadway on which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger. No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield. A pedestrian’s right-of-way in a crosswalk is subject to the modification of EMC 10.20.050.

(B) Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass the stopped vehicle. 10.20.030 Pedestrians to use right half of crosswalk.

Pedestrians shall move, whenever practicable, on the right half of crosswalks. [1962 Code § 351.03; 1982 Code § 73.03; 1983 Code § 7.73.03.]

10.20.040 Crossing at right angles.

No pedestrian shall cross a roadway at any place other than by a route at right angles to the curb or by the shortest route to the opposite curb, except in a crosswalk. [1962 Code § 351.04; 1982 Code § 73.04; 1983 Code § 7.73.04.]

10.20.050 Pedestrians to yield at certain times and places.

Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles on the roadway. Any pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right-of-way to all vehicles on the roadway. These rules have no application under the conditions stated in EMC 10.20.020 when pedestrians are prohibited from crossing at certain designated places. 10.20.060 Prohibited crossing.

Between adjacent intersections at which traffic-control signals are in operation, pedestrians shall not cross at any place except in a crosswalk. In any business district no pedestrian shall cross a roadway other than in a crosswalk. No pedestrian shall cross a roadway other than in a crosswalk on any of the through streets designated by ordinance, or on any street bordering a City block in which there is located a primary or secondary school. 10.20.070 Penalty.

(A) Any person who violates any provision of this chapter shall be subject to the penalties set forth in EMC 10.05.200.

(B) There is hereby imposed a fine of not less than $25.00 nor more than $2,500 on the owner or the person in control of a vehicle, motor vehicle, bicycle, or motorcycle which is used, operated, or parked in a manner which violates any of the provisions of Section 7.73.07. The City Clerk is hereby authorized to accept the payment of $25.00 from anyone who admits that he violated any of the provisions of Section 7.73.07, and offers payment prior to the initiation of litigation by the City to enforce the provisions of Section 7.73.07. However, this shall not be construed so as to require the City Clerk to delay the initiation of litigation to enforce the provisions of Section 7.73.07. [Ord.
