ARTICLE 15. PENALTIES

2-1501. PENALTIES.

Any person violating any provision of this chapter shall be deemed guilty of an ordinance violation and upon conviction of any such violation shall, unless another specific penalty or specific penalty range be provided by another subsection of this section, be punished by a fine of not less than $50 nor more than $2500, or by imprisonment for a term not to exceed 180 days or by both such fine and imprisonment. 2-1502. VIOLATIONS.

Any person violating any of the following sections of these chapters:

Article 5. Good Neighbor Provisions

 

Section 2-501, Dogs and Cats Running at Large — Prohibited

 

Section 2-505, Limitation on Number of Dogs and Cats

Article 10. Dog and Cat Identification

shall, upon conviction and after the court, subsequent to such conviction, has examined any prior conviction record to determine if the person has previously been convicted of the same offense, be sentenced by the court according to the following schedule of fines with reference to initial or subsequent violation of the particular section:

First Offense

$ 50

Second Offense

$ 100

Third Offense

$ 200

Fourth Offense

$ 400

Fifth Offense

$ 1,000

and for the sixth or any subsequent offense -- $ 2,000.

2-1503. SAME.

Any person violating any of the following sections of these chapters:

Article 8, The Keeping of Livestock and Certain Other Animals

Article 9, The Keeping of Small Animals and Fowl

Article 5, Good Neighbor Provisions

 

Section 2-502, Dogs and Cats in Heat

 

Section 2-503, Dogs or Other Animals Putting Persons in Fear

 

Section 2-504, Excessive Animal Noise

 

Section 2-506, Sec. 6, Dangerous Dogs

shall, upon conviction and after the court, subsequent to such conviction, has examined any prior conviction record to determine if the person has previously been convicted of the same offense, be sentenced by the court according to the following schedule of fines with reference to initial or subsequent violation of the particular section:

First Offense

$ 200

Second Offense

$ 600

Third Offense

$ 1,000

and for the fourth or any subsequent offense -- $ 2,000.

2-1503 (a) SAME.

Any person violating any of the following sections of these chapters:

Article 4, Care of Animals

Article 6, Abuse to Animals Forbidden

shall, upon conviction and after the court, subsequent to such conviction, has examined any prior conviction record to determine if the person has previously been convicted of the same offense, be sentenced by the court according to the following schedule of fines with reference to initial or subsequent violation of the particular section:

First Offense

$ 500

Second Offense

$ 1,000

Third Offense

$ 1,500

and for the fourth or any subsequent offense $ 2,500.

2-1504. SAME.

Any person violating any of the following sections of this chapter:

Article 12, Animal Bites and Disease Control

 

Section 2-1201, Sec. 1, Domestic Dog and Cat Bites Resulting in Human Exposure to Rabies

 

Section 2-1202, Human Exposure to Zoonotic Diseases by Animals Other than Dogs or Cats

Article 10, Dog and Cat Identification

 

Section 2-1009, Sec. 9, False Certificates

Article 11, Disposition of Impounded Animals

 

Section 2-1106(b), Failure to Have an Adopted Animal Neutered

shall, upon conviction, be punished by a fine of not less than $250 nor no more than $1,000 or by imprisonment for a term not to exceed 180 days, or by both such fine and imprisonment. (Ord. 1317).

2-1505. SAME.

Each day’s violation of, or failure, refusal or neglect to comply with, any provision of this chapter, shall constitute a separate and distinct offense. The same violation for more than one animal shall constitute a separate and distinct offense as to each animal. (Ord. 1317)
