2.30.010 Commission established.
The Monmouth City Council finds that art and culture are important qualitative measures of the health and vitality of a community; and the presence of art and cultural activities attracts businesses, improves commercial and public areas through beautification and creation of appealing venues, attracts tourists; and the Council finds that the stimulation of community art and cultural activities is a proper facilitative role for City government. There is hereby created and established a commission to be entitled and designated as the Arts and Culture Commission. (Ord. 1290, § 2, August 2, 2011. Code 1983 § 28.100.)
2.30.020 Responsibilities and duties.
Under the direction of the City Council, the Commission’s responsibilities and duties include:
(1) Encouraging opportunities for recognition of art and culture in the City of Monmouth.
(2) Providing coordination and communication among groups and individuals engaged in artistic and cultural activities, including coordination of events to showcase the abilities of area artists.
(3) Identifying funding sources and helping to secure such funding as necessary to promote artistic and cultural activities in the City of Monmouth.
(4) Identifying groups and organizations which could bring artistic and cultural activities and enrichment to the City of Monmouth.
(5) Developing and maintaining a five-year plan for artistic and cultural activities in the City of Monmouth, subject to approval by the City Council. The plan shall include, but not be limited to, proposed capital improvement projects for public art.
(6) Providing a liaison and recommendations to the City Council and other City commissions and boards regarding projects in the five-year plan and other approved visual arts projects.
(7) Soliciting arts promoting funds or grants from individuals, businesses, corporations, and other governmental agencies; provided, however, that such solicitation shall not commit the City of Monmouth in any way without prior City Council approval. Any such funds or grants collected by the Commission shall be subject to all provisions of law, including local budget law.
(8) Making recommendations regarding all matters involving public arts and the cultural development of the City.
(9) Such other responsibilities relating to arts and culture within and affecting the City of Monmouth as the City Council may, from time to time, direct. (Ord. 1290, § 3, August 2, 2011. Code 1983 § 28.110.)
2.30.030 Definition of arts and culture.
“Arts” and “culture” shall include but not be limited to instrumental and vocal music; drama; dance; creative writing and poetry; architecture, landscape design and fields allied to them; painting; folk art; sculpture; photography; graphics and craft arts; industrial design; costume and fashion design; film, video and audio (such as cable broadcast, television and radio); tape and sound recording; the history, criticism, theory and practice of the arts; and the arts related to the presentation, performance, execution, and exhibition of such art forms; and such other like endeavors as may be designated by the Commission. 2.30.040 Membership.
The Commission shall consist of seven members appointed by the Mayor and approved by the City Council, at least six of whom shall be residents of the City at the time of their nomination, appointment, and at all times during their term in office. A nonresident member may be appointed and approved when the Mayor and City Council determine that such individual has special qualifications and expertise in the subject matter of the Commission and has expressed interest in being appointed and serving and advancing the interests of the City. 2.30.050 Term of office.
The term of office shall be three years. (Ord. 1290, § 6, August 2, 2011. Code 1983 § 28.140.)
2.30.060 Vacancies and removals.
Any vacancies shall be filled by appointment by the Mayor with approval by the Council. Any member may be removed for cause. A member of the Commission who is absent from three consecutive meetings without an excuse approved by the Commission is presumed to be in nonperformance of duty and the City Council may declare the position vacant and appoint a new member to fill the unexpired term. A member who ceases to qualify during the term of office by reason of the residency requirements under MCC 2.30.040 shall be disqualified from the Commission and such member’s position shall be deemed vacant. 2.30.070 Officers.
The Commission at its first meeting on or after July 1st, each year, shall select one member to be the chairperson, another to be vice-chairperson and another to be secretary. The chairperson shall preside over the meetings of the Commission and perform such other duties as may be delegated by the Commission. The vice-chairperson shall act in the absence of the chairperson. The secretary shall take and prepare the minutes of the Commission in accordance with ORS 192.610 through 192.650. The secretary shall forward to the City Recorder, monthly, a copy of the minutes of the meetings of the Commission. The secretary shall keep all the records of the Commission and shall perform such other duties as may be delegated by the Commission. The secretarial duties may be delegated to staff. 2.30.080 Meetings.
The Commission shall meet at times and dates to be set by rule of the Commission, and may meet upon the call of the chairperson or on call by a majority of its members. If necessary, members may attend the meeting by conference call in accordance with ORS 192.670(2). (Ord. 1290, § 9, August 2, 2011. Code 1983 § 28.170.)
2.30.090 Procedures.
The Commission’s procedures shall be in accordance with Robert’s Rules of Order. The Commission may adopt supplementary rules of procedure. All meetings are subject to the requirements of the Oregon Public Meetings Law (ORS 192.610 to 192.690). A majority of the members of the Commission shall constitute a quorum for the conduct of business and the concurrence of a majority of those members present shall be required to decide any matter. If the Commission is unable, because of a lack of a quorum or other cause, to act or make a recommendation on any matter before it in a timely manner, the City Council may act on the matter directly. 2.30.100 Council liaison.
The Mayor shall appoint a Council liaison to the Commission. It shall be the responsibility of the Council liaison to attend the meetings of the Commission, report on actions taken and facilitate communication between the Commission and the City Council. The Council liaison is not a member of the Commission, shall not count toward the quorum requirements of the Commission and shall not have a vote on the Commission. (Ord. 1290, § 11, August 2, 2011. 2.30.110 Staff support.
The City Manager shall assign staff to the Commission. Staff’s responsibility shall be to give the Commission neutral guidance and answer any questions of the Commission members. The staff person is not a member of the Commission. (Ord. 1290, § 12, August 2, 2011. Code 1983 § 28.200.)
