24.12.230 Performance bond requirement.
(1) Solid waste disposal sites shall be required to post a performance bond, or equivalent which is satisfactory to the health officer in amount sufficient to correct possible safety and health problems, before a solid waste disposal site permit will be issued by the local health officer. Monies from the bond or equivalent may be used by the jurisdictional board of health for any appropriate purposes, including providing final cover and/or final surface.
(2) If any action or activity required by the State of Washington Minimum Functional Standards for Solid Waste Handling, or required by this chapter is not performed as required, the jurisdictional board of health may undertake action to forfeit the bond to upgrade the site to meet state and county standards.
(3) The bond will not be released until the health officer has issued a certificate of completion in which it finds that the site has been completed in compliance with any permit or license issued and any provision of any applicable local, state or federal law.
(4) Municipal corporations and political subdivisions of this state shall be exempt from the bond requirements of this chapter. (Sec. 23, Ord. No. 1978-02-01; amended by Sec. 18 of Ord. 1982-12-83; amended by Sec. 1 of Ord. 2006-09-13)
