24.12.235 Escrow account.
Where the nature of the solid waste facility will necessitate on-site monitoring and maintenance of a gas and/or leachate control system following closure of the facility, the permit shall require the establishment of an escrow account, or other approved secure method, into which the permittee shall annually contribute the amount determined by the health officer to be actuarially sufficient to defray the future costs of such on-site monitoring and maintenance. Funds within such escrow account shall not be withdrawn except by or upon the approval of the health officer. Upon the determination of the health officer that no further monitoring or maintenance is needed, such account shall be released and any funds remaining therein shall be refunded to the permittee.
