10.04.010 Uniformity with Motor Vehicle Act.
In order to make the ordinances of the city uniform with the laws of the state of Washington, all of the provisions of the Washington State Motor Vehicle Act, Chapter 46.12 RCW, as amended, or as they hereafter may be amended; and all the provisions of the Washington Highway License Act, RCW 46.01.110, as amended, or as they may hereafter be amended, are hereby adopted by the city and are by reference made a part of this chapter. (Ord. 326 § 1, 1952).
10.04.020 Violation of DMC 10.04.010.
Any person violating any of the terms of the laws referred to in DMC 10.04.010 within the limits of the city is guilty of a violation of this chapter. (Ord. 326 § 2, 1952).
10.04.030 No parking districts – Street closure.
On holidays and special occasions which tend to increase traffic, the chief of police shall have power and authority to establish by appropriate signs or enclosures, districts wherein no parking of any vehicle shall be allowed. On streets where building operations are being carried on, and for public safety when traffic is congested, the chief of police temporarily may close any street or portion of a street to all vehicle traffic. (Ord. 326 § 3, 1952).
10.04.040 Parking prohibited – Curb painting.
The city shall have full power and authority to designate portions of any street within the city that shall not be used for parking purposes, and it shall be the duty of the street superintendent to cause to be painted and designated in color the curbing of that portion of the street where parking is prohibited. (Ord. 326 § 4, 1952).
10.04.050 Sign placement authority.
The city shall have full power and authority to designate the location of traffic signs and standards within the city, and it is unlawful for any other person to place or exhibit any traffic sign or standard, to print or paint anything on the sidewalks or streets of the city without a permit so to do from the city. (Ord. 326 § 5, 1952).
10.04.060 U-turns.
No operator of a motor vehicle shall make a U-turn on the streets of Davenport at any place other than an intersection of streets in the city, with the exception of the intersections of Fifth and Morgan, Sixth and Morgan, Seventh and Morgan and Eighth and Morgan Streets. (Ord. 528 § 2, 1980; Ord. 326 § 6, 1952).
10.04.070 Backing around a corner.
No operator of a motor vehicle shall back around a corner upon the streets of the city at an intersection of streets. (Ord. 326 § 7, 1952).
10.04.080 Overtaking a vehicle.
No vehicle shall overtake or pass or attempt to pass another vehicle going in the same direction, at a street intersection except by the direction of a traffic officer. (Ord. 326 § 8, 1952).
10.04.090 Places where stopping, standing, parking are prohibited.
No person shall stop, stand, or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the direction of a peace officer or traffic control device, in any of the following places:
(1) On a sidewalk;
(2) Within an intersection;
(3) On a crosswalk;
(4) Within 20 feet of a fire hydrant;
(5) On the roadside of any vehicle stopped or parked at the edge or curb of a street;
(6) At any place where official signs prohibit stopping;
(7) In front of any alley or public or private driveway or within five feet of the curb radius leading thereto. (Ord. 326 § 9, 1952).
10.04.100 Parking – Conformance with markings.
In parking motor vehicles upon the public streets wherein lines for parking have been marked or painted, it shall be the duty of all persons to park such vehicles in conformity with said markings and lines as so established or painted on such street. Any persons violating the provisions of this section are guilty of a violation of this chapter. (Ord. 326 § 10, 1952).
10.04.110 Vehicle driving over park unlawful.
It is unlawful for any person to drive or operate a motor vehicle over, upon or across any city park or other public property and/or to damage or destroy any city or private property by driving or operating a motor vehicle thereon or against the same, and in addition to any other penalty provided in this code, the court may require any person convicted of a violation of this section to make appropriate restitution for any damage to said public or private property as mentioned in this section. 10.04.120 Obedience to traffic signals.
It shall be the duty of all users of the streets of the city to obey and follow all traffic signals, signs, and instructions on or over the streets of the city. (Ord. 326 § 12, 1952).
10.04.130 Violation of chapter.
Except as otherwise provided in this chapter, any person who violates or fails to comply with any of the provisions of this chapter, or who counsels, aids or abets any such violation or failure to comply, shall be deemed guilty of a civil infraction, and upon conviction thereof, shall be punished as provided in DMC 1.04.010.
