15.02.010 Washington State Building Code – Amendment for performance standards.
The Washington State Building Code that applies to the city shall be forthwith amended to provide for minimum performance standards and objectives as enumerated in Chapter 19.27 RCW and any subsequent amendment thereto by the Washington State Legislature. 15.02.020 Washington State Building Code – Amendment to adopt uniform codes.
The Washington State Building Code as it applies to the city shall be amended to provide for adoption by reference of the following codes:
(1) The International Building Code, current edition, together with Appendix C, “Agricultural Building” and Appendix J, “Grading,” except for Chapter 27, which is not adopted, as published by the International Code Council;
(2) The International Mechanical Code, current edition, as published by the International Code Council;
(3) The 2018 International Fire Code, together with Appendix B, “Fire-flow Requirements for Buildings,” Appendix C, “Fire Hydrant Locations and Distribution,” and Appendix D, “Fire Apparatus Access Roads,” as published by the International Code Council;
(4) The Uniform Plumbing Code, current edition, as published by International Association of Plumbing and Mechanical Officials, except for Chapters 12, 15 and for those requirements relating to venting and combustion air of fuel-fired appliances as found in Chapter 5 and Chapter 11 for storm drainage which is not adopted, as published by the International Association of Plumbing and Mechanical Officials;
(5) The Washington State Regulations for Barrier-Free Design Standards, current edition, published by the Washington Association of Builders, which sets rules and regulations for making buildings and facilities accessible to and usable by the physically handicapped or elderly persons; and the IBC Chapter 11 and ICC A117.1-2009;
(6) The Uniform Code for Abatement of Dangerous Buildings, current edition, published by the International Conference of Building Officials;
(7) The International Residential Code, current edition, except for Chapters 11 and 25 through 42 which are not adopted, as published by the International Code Council;

15.02.030 Conflicts in codes.
In the case of conflict among the codes enumerated in subsections DMC 15.02.020(1) through (8), the first-named code shall govern over those following. (Ord. 1156 § 1, 2020; Ord. 662 § 1, 1989; Ord. 492 § 3, 1978).
15.02.040 Adoption of revisions.
The city council shall have the authority to adopt any subsequent revisions to the codes enumerated in Chapter 19.27 RCW. (Ord. 1156 § 1, 2020; Ord. 662 § 1, 1989; Ord. 492 § 4, 1978).
15.02.050 Supplements and appendices – Books available.
All supplements and appendices to codes enumerated in Chapter 19.27 RCW are adopted and in force as part of this code. Reference books for the adopted codes are available at the city clerk-treasurer’s office. (Ord. 1156 § 1, 2020; Ord. 662 § 1, 1989; Ord. 491 § 1, 1978).
15.02.060 Unlawful acts and violations – Penalties.
(a) Unlawful Acts. It is unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building or structure or cause to permit the same to be done in violation of this code.
(b) Violation – Penalty. Any person who violates the provisions of this code or fails to comply with any of its requirements, or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents, directive of the building official, or a permit or certificate issued under the provisions of the code, shall be subject to penalties set forth in Chapter 1.04 DMC, General Penalty.
(1) Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of the city of Davenport shall be guilty of a civil infraction. Any person convicted of a civil infraction under the ordinances of the city of Davenport shall be punished by a fine as follows:
(A) First offense, $150.00 plus state assessments;
(B) Second offense, $300.00 plus state assessments;
(C) Third offense, $500.00 plus state assessments;
(D) Any offense after the third offense shall be $500.00 per offense plus state assessments.
(2) Each person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of the city of Davenport is committed, continued, or permitted by any such person, and he shall be punished accordingly.
(3) All costs incurred by the city in attempting to enforce compliance of this chapter, including, but not limited to, court costs, attorney fees and the collection of fees and fines, shall be borne and assumed by the person found guilty of the infraction. (Ord. 1156 § 1, 2020).
