3.12.010 Nonpayment for want of funds—Interest.
Whenever any warrants hereafter drawn upon the treasury of the city to be paid from local improvement district fund, on which said warrant was drawn is presented to the city treasurer for payment, and there shall not be moneys in said fund with which to pay the same the treasurer shall endorse on said warrant the words “not paid for want of funds” with the day and date of such presentation and from the date of the delinquency of the assessments in the district on which said warrant is drawn, said warrant shall draw interest at the rate of eight percent per annum. 3.12.020 Record of unpaid warrants—Calling in.
The city treasurer shall keep a record of all warrants presented to him for payment and so endorsed by him together with the date when each warrant so endorsed was so presented and the numbers of the same and he shall thereafter call in such warrants in the order in which they were issued by the city clerk of said city. 3.12.030 Notice, payment when funds available.
Whenever the city treasurer shall have money on hand and there shall be outstanding warrants, he shall forthwith cause to be published in the official paper a notice designating by numbers the warrants which he is prepared to pay. If such warrants so designated be not presented to him for payment, the interest upon the same shall cease from the date of the first publication of said notice. The treasurer shall retain funds sufficient to redeem said warrants in their order with interest up to the date of publication of said notice. (Prior code § 1.64.030)
3.12.040 Effect of chapter on existing contracts.
None of the provisions of Section 3.12.010 shall be so construed as to affect any contract existing at the date of the passage of this chapter and to which said city is a party. (Prior code § 1.64.040)
3.12.050 Authority to sign.
A. In the event of the absence from the city or during the disability of the commissioner of finance the commissioner of public works shall be authorized to sign all warrants of the city in the place of the commissioner of finance during such absence or disability, and in the event of the absence from the city or during the disability of both the commissioner of finance and the commissioner of public works the commissioner of safety shall be authorized to sign city warrants during such absence or during such disability of both of such officers.
B. In the event of the absence from the city or during the disability of the city clerk the deputy city clerk shall be authorized to sign city warrants in the place of the city clerk during such absence or disability. (Prior code § 1.64.050)
3.12.060 Issuance—Auditing officer approval.
Warrants may be issued in payment of claims prior to approval by the city council but only after approval by the city’s auditing officer. (Ord. 1082-84 § 1, 1984)
3.12.070 Issuance—Bonding of officers.
The mayor and city’s auditing officer shall each furnish an official bond in the amount of fifty thousand dollars each for the faithful discharge of his or her duties in regard to the issuance of warrants for the payment of claims. (Ord. 1082-84 § 2, 1984)
3.12.080 City council review and approval.
The city council shall review and approve all warrants issued in payment of claims at its first regularly scheduled public meeting following the date the warrants are issued. (Ord. 1082-84 § 3, 1984)
3.12.090 Collection of disapproved claims.
Any claims paid and subsequently disapproved by the city council shall be recognized as receivables of the city, and the mayor and city’s auditing officer shall pursue collection until the amounts disapproved are collected or until the city council is satisfied and approves the claim.
