LONGVIEW VISUAL ARTS COMMISSION

2.28.010 Definitions.
(1) “Visual art” means:
(a) Calligraphy and signage;
(b) Crafts – in clay, glass, paper, fiber and textiles, wood, metal, plastics, and other materials;
(c) Graphic arts – printmaking and drawing;
(d) Mixed media – any combination of forms and media, including collage and assemblages;
(e) Mosaics – tile and brickwork;
(f) Painting – all media, including portable and permanently affixed works, such as murals;
(g) Photography;
(h) Sculpture – in the round, bas relief, high relief, mobile, fountain, kinetic, electronic, play equipment, etc., in any material or combination of materials.
(2) “Artist” means a practitioner in the visual arts who produces artwork as described above and exhibits in recognized forums, or one who possesses an “objet d’art” of particular appeal and/or usefulness to the city of Longview.
(3) “Public building” means a building owned by the city of Longview.
(4) “Public areas of public buildings” means foyers, assembly areas, waiting rooms, and meeting rooms open to the public in general.
(5) “Public parks” means parks, playgrounds, and public buildings located in and owned and maintained by the city of Longview.
(6) “Other public place” means the land constituting the grounds of public buildings, cultivated median areas of public streets, unimproved land owned by the city, and city-owned or leased parking lots. (Ord. 2808 § 1, 2001).
2.28.020 Creation – Qualifications of members – Terms – Appointments – Compensation.
(1) There is hereby established the “Longview visual arts commission”, consisting of five members.
(2) All members of the Longview visual arts commission shall have a demonstrated interest in and knowledge of visual art and possess qualities of impartiality and objective judgment. Whenever reasonably possible, members shall include individuals possessing knowledge and expertise in varied fields of visual art, including artists, sculptors, photographers, teachers, collectors and dealers.
(3) Each member of the Longview visual arts commission shall be and remain a resident of the city, or shall be and remain the owner or manager of a licensed business within the city, or possess a demonstrated interest and/or expertise in the field of visual art. No more than two members of the commission may reside outside the city of Longview.
(4) Each member of the Longview visual arts commission shall be appointed for a term of three years except for the first members, who shall be appointed to serve the following terms: one member shall be appointed for a one-year term; two members shall be appointed for two-year terms; and two members shall be appointed for three-year terms. Upon the expiration of the terms of the initial members, appointees shall serve for three-year terms. In the event of a vacancy, a member shall be appointed to fill the remainder of the term of the position created by such vacancy.
(5) All members of the Longview visual arts commission shall be appointed by the city manager.
(6) Members of the Longview visual arts commission shall serve without compensation. (Ord. 2808 § 1, 2001).
2.28.030 Meetings.
Regular meetings of the Longview visual arts commission shall be held not less often than quarterly, and special meetings may be held as provided in the bylaws of the commission. All meetings of the commission shall be subject to the open meetings laws of the state of Washington, and shall be held at such time and place as is provided by the bylaws of the commission. 2.28.040 Purpose.
The purpose of this chapter is to provide for the establishment of the Longview visual arts commission, the responsibilities of which shall include the following:
(1) To determine the appropriateness, placement, and display of visual art in public areas of public buildings, public parks and other public places;
(2) To develop and recommend to the city council a policy, criteria and procedure for acceptance of the ownership of visual art by the city of Longview;
(3) To encourage and promote participation and appreciation of visual art as an integral part of community life;
(4) To promote and encourage public programs to further the development of public awareness of and interest in visual art;
(5) To advise the city council in connection with the visual artistic development of the Longview area;
(6) To encourage donations, grants or other support to further expand visual art programs and services. (Ord. 2808 § 1, 2001).
2.28.050 Powers and duties.
The Longview visual arts commission shall have the following powers and duties:
(1) To adopt bylaws consistent with this chapter;
(2) To serve as an advocate of visual art, and to promote a high level of quality, creativity and diversity in connection with visual art, including encouragement of aesthetic considerations in local decision-making that may have cultural implications;
(3) To review the design, execution and acceptance of visual art funded or otherwise acquired by the city to ensure that donations or purchases are consistent with the goals of the commission and within the authority of the city;
(4) To provide information or assistance to visual art organizations, artists and others interested in visual art;
(5) To encourage, conduct, sponsor or co-sponsor public programs to further the development and public awareness of and interest in visual art;
(6) To consult with and provide advice to city departments in connection with the appropriateness and prior to the placement and display of visual art in public areas of public buildings, public parks and other public places. (Ord. 2808 § 1, 2001).
2.28.060 Placement or display of visual art in public places.
(1) Public Parks. No visual art may be placed or displayed in any public park in the city, or in or on any public building situated in a public park in the city without the prior written approval of the Longview visual arts commission, given to the parks and recreation advisory board.
(2) Public Areas of Public Buildings, Grounds of Public Buildings, and Other Public Places. No visual art may be placed on or in public areas of public buildings, grounds of public buildings or other public places without the prior written approval of the Longview visual arts commission, given to the city manager. 2.28.065 Inapplicability to Longview Public Library, art shows, and private displays of visual art in public places.
This chapter shall not be applicable to the temporary display of visual art, not owned by the city, in the Longview Public Library or temporary displays or sales of visual art otherwise permitted in other public places. This chapter shall also not be applicable to the placement or display of visual art in nonpublic areas of public buildings. (Ord. 2808 § 1, 2001).*

2.28.067 Assistance from city administration.
The city manager shall designate a person to assist, advise and consult with the Longview visual arts commission, and to act as secretary thereof, and shall arrange for a meeting room for regular and special meetings of the commission. (Ord. 2808 § 1, 2001).*

2.28.070 Vacancies.
The failure of a member of the Longview visual arts commission to attend two successive meetings of said commission, or the failure of a member to continually meet the qualifications for membership described in LMC 2.28.020(3), shall result in the removal, by the city manager, of such member from the commission. Vacancies caused by removal, death, or resignation shall be filled for the remainder of the term of the vacant position. (Ord. 2808 § 1, 2001).
