17.04.010 Title.
The ordinance codified in this title shall hereafter be known as the “Subdivision Ordinance” of the city. (Ord. 191 § 1, 1967).
17.04.020 Final approval.
No person, association or corporation may alter or revise the boundary lines of any property, or divide for separate ownership any land which would result in a division of land containing two or more lots or a dedication of any part of a lot as a public street or highway, prior to final approval or dedication of the proposed plat, from the city council for regular subdivisions, or from the city manager or designee for short subdivisions, in accordance with the prescribed rules and regulations in this title. Pre-sale of proposed lots may be allowed provided the sale is contingent on receiving final approval. This provision shall apply to all cases falling within the provisions of Chapter 17.12 NPMC. 17.04.030 Minimum lot area.
A subdivision, short subdivision or lot line adjustment that creates a lot or lots not meeting minimum area and dimension requirements for a lot under NPMC Title 18 shall not be approved, unless the applicant agrees to record a covenant with the land dedicating such lots to serve other lots in the subdivision, removing them from development rights, and making the dedication binding upon heirs, successors and assigns. 17.04.050 Subdivision in environmentally sensitive areas (ESA).
Subdivision and short subdivision of land in an ESA, as defined in NPMC 13.16.030(14), is subject to the following:
(1) Land that is located wholly within an ESA may not be subdivided.
(2) Land that is located partially within an ESA may be subdivided; provided, that an accessible and contiguous portion of each new lot is:
(a) Located outside the ESA and its buffer;
(b) Meets the minimum lot size requirements of NPMC Title 18; and
(c) Meets the “buildable site” criteria in NPMC 17.40.040. (Ord. 780 § 3, 2006).
17.04.150 Right-of-way dedications.
No petition submitted to the city for platting, replatting or subdivision of land shall be approved unless, as a condition for approval, owners of the land to be platted or divided shall grant to the city, or dedicate for public street purposes, any portions of a parcel, within the proposed plat or subdivision, that is located within the right-of-way of a future city street as proposed within the city’s official comprehensive plan. Such grant or dedication shall include a strip of sufficient width (or so much thereof as lies within petitioner’s land) to comply with the city’s standard relating to the rights-of-way for city streets of the several classes as specified in NPMC 17.32.050.
