9.04.010 Title of ordinance.

The ordinance codified in this chapter shall be known and may be cited as the “Okanogan Municipal Criminal Code.” (Ord. 560 § 1, 1978)

9.04.020 State provisions adopted.

The following sections of RCW Title 9A are adopted by reference as if the same were fully set forth in this chapter, except that the penalty provisions thereof are superseded by the penalty provisions of this chapter as set forth in OMC 9.04.050; any reference to felonies or classification of felonies shall refer to the statutes of the state for definition and prosecution:

9.04.030 Authority – Copies on file.

The ordinance codified in this chapter is adopted in accordance with the provisions of RCW 35.21.180 and prior to its adoption three copies of the sections of RCW Title 9A enumerated in OMC 9.04.020 have been filed in the office of the city clerk-treasurer for use and examination by the public. (Ord. 560 § 4, 1978)

9.04.040 Amendments to statutes.

The amendment, addition or repeal by the Washington Legislature of any sections of any of the adopted statutes shall be deemed to amend this chapter and the statutes contained in this chapter which are adopted by reference in conformity with the amendment, addition or repeal, and it shall not be necessary for the legislative authority or this city to take any action with respect to such addition, amendment or repeal as provided by RCW 35.21.180. 9.04.050 Violation – Penalty.

Any person, firm, corporation or association violating any of the provisions of this chapter is guilty of a misdemeanor or gross misdemeanor as provided in this chapter and shall be subject to a fine of not more than $500.00 and imprisonment for a term not exceeding 90 days or both. (Ord. 560 § 3, 1978)
