Article I. Contributing to Delinquency
9.08.010 Definitions.
As used in this article:
A. “Delinquent child” means any child under the age of 18 years who violates any law of this state, or any ordinance of any town, city or county of this state defining a crime or who has violated any federal law or law of another state defining a crime, and whose case has been referred to the juvenile court by any jurisdiction whatsoever.
B. “Dependent child” means any child under the age of 18 years:
1. Who has no home or any settled place of abode, or any proper guardianship, or any visible means of subsistence; or
2. Who has no parent, guardian or other responsible person, or who has no parent or guardian willing to exercise, or capable of exercising, proper parental control; or
3. Whose home by reason of neglect, cruelty or depravity of his parents or either of them, or on the part of his guardian, or on the part of the person in whose custody or care he may be, or for any other reason, is an unfit place for such child; or
4. Who frequents the company of reputed criminals, vagrants or prostitutes; or
5. Who is found living or being in any house of prostitution or assignation; or
6. Who habitually visits any saloon, or place where spirituous, vinous or malt liquors are consumed or sold, bartered or given away; or
7. Who in incorrigible; that is, who is beyond the control and power of his parents, guardian or custodian by reason of the conduct or nature of the child; or
8. Who is in danger of being brought up to lead an idle, dissolute or immoral life; or
9. Who is an habitual truant, as defined in the school laws of the state of Washington; or
10. Who uses intoxicating liquor as a beverage, or who uses opium, cocaine, morphine, heroin or marijuana, or other similar drug, without the direction of a competent physician; or
11. Who wanders about in the nighttime without being on any lawful business or occupation; or
12. Who is unlawfully neglected as to medical care necessary to his well-being. (Ord. 383 § 1, 1970)
9.08.020 Misdemeanor – Penalty.
In all cases where any child is dependent or delinquent under the terms of this article, the parent or parents, legal guardian or person having custody of such child, or any other persons who, by any act or omission, encourages, causes or contributes to the dependency or delinquency of such child is guilty of a misdemeanor. Article II. Curfew
9.08.030 Hours designated.
It is unlawful for any child or children under the age or 18 years to be or remain on the streets of the city or on or in any public or unoccupied grounds or business district of the city or to loiter around or in or congregate or remain in any business house or place of business after the hour of 10:30 p.m. The above shall not apply to any children or child in the company of parents or of any adult or adults having custody of her or him or them nor to any child or children who may be sent on any necessary errand by the parents, parent or custodian while pursuing such errand with due diligence. 9.08.040 Enforcement.
It is the duty of the chief of police, or any police officer, to order all children found in the streets of the city in violation of OMC 9.08.030 to immediately return to their homes, and upon a second violation of this article, shall arrest and detain children found violating this article. (Ord. 170 § 2, 1943)
9.08.050 Violation – Penalty.
Any child violating this article, or any parent or parents or person or persons having the custody of any child, or any person whomsoever, who by any act or omission encourages, permits or allows any child to violate OMC 9.08.030 is guilty of a misdemeanor and on conviction thereof shall be fined not less than $5.00 nor more than $100.00 and be imprisoned until such fine and costs are paid. Article III. Leaving Children Unattended in Motor Vehicles
9.08.060 Unlawful.
It is unlawful for any person having the care and custody, temporary or permanent, of a minor child or minor children under the age of 12 years, to leave such child or children unattended by an adult in a motor vehicle parked on any public street or place in the city. (Ord. 422 § 1, 1972)
9.08.070 Violation – Penalty.
Any person who violates this article shall, upon conviction thereof, be punished by a fine of not to exceed $100.00 or by imprisonment in the city jail for not more than 15 days, or by both such fine and imprisonment. (Ord. 422 § 2, 1972)
Article IV. Weapons
9.08.080 Possession of certain devices.
It is unlawful for any person under the age of 21 years to have in his possession or under his control in the city, except within the confines of the house where he is living, any air rifles, air pistols, BB guns, slingshots, bean shooters and similar devices. (Ord. 303 § 1, 1959)
9.08.090 Discharge of certain devices.
It is unlawful for any person under the age of 21 years or any person over the age of 21years to fire or shoot or discharge in the city any BB guns, air rifles, air pistols, slingshots, bean shooters or similar devices. (Ord. 303 § 2, 1959)
9.08.100 Violation – Possession.
Any person or persons found guilty of violating any of the provisions of OMC 9.08.080 is guilty of a misdemeanor and shall be punished by fine of not more than $300.00 or imprisonment not to exceed 90 days or both and the devices made illegal by OMC 9.08.080 shall be forfeited by the person or persons violating the same and the same shall be confiscated by the city. 9.08.110 Violation – Discharge.
Any person or persons found guilty of violating any of the provisions of OMC 9.08.090 is guilty of a misdemeanor and shall be punished by a fine of not more than $300.00 or imprisonment not to exceed more than 90 days or both and the devices made illegal by OMC 9.08.090 shall be forfeited by the person or persons violating the same and the same shall be confiscated by the city.
