9.16.010 Public disturbance by noise – Unlawful.

It is unlawful to create, or to allow property in one’s possession or control to be used so as to create any loud, unpleasant or raucous noise which unreasonably disturbs the peace, comfort or repose of others. (Ord. 88-1 § 1, 1988).

9.16.020 Enumerated.

Noise disturbances referred to in OCC 9.16.010 may include but are not limited to continuous or repetitive:

A. Operating motors and engines;

B. Playing amplified or otherwise loud music either live or recorded;

C. Yelling or shouting;

D. Allowing domestic animals to bark, howl or otherwise make noise;

E. Use of noisemaking fireworks except for duly authorized or approved public displays. (Ord. 88-1 § 2, 1988).

9.16.030 Presumption.

It shall be a rebuttable presumption that any activities enumerated in this chapter disturb the peace, comfort or repose of others when they take place between the hours of 10:30 p.m., and 7:00 a.m., in a residential area or one containing hospitals, hostelries, convalescent centers or other places of repose. (Ord. 88-1 § 3, 1988).

9.16.040 Exemptions.

A. The noises or sounds produced by the operations of agricultural equipment for the purpose of production or protection of crops are exempt from this chapter.

B. The noises or sounds produced from or in the raising of production livestock including, but not limited to horses, cattle, sheep, pigs and poultry are exempt from this chapter. (Ord. 88-1 § 4, 1988).

9.16.050 Violation – Penalty.

Any person violating this chapter shall, upon conviction thereof, be punishable by fine not to exceed $500.00 or imprisonment not to exceed 90 days, or both. (Ord. 88-1 § 5, 1988).
