Article I. Parking Limit Committee
10.16.010 Created.
There is hereby created a parking committee consisting of two Westport city council persons. (Ord. 1620, 2019)
10.16.020 Authority.
The parking committee shall recommend to the mayor and city council any reasonable change, alteration, deletion or addition of any ordinance relating to parking, including but not limited to time parking, loading/unloading, service vehicles, police, fire or handicapped parking zones. Article II. Service Vehicles
10.16.030 Council to establish service vehicle zones.
The city council of the city of Westport is hereby empowered to designate parking zones for “Service Vehicles Only” which display a valid permit, decal or sticker issued by the city of Westport. (Ord. 1620, 2019)
10.16.035 Application to licensed taxis.
The term “service vehicle” shall include licensed taxis. (Ord. 1620, 2019)
10.16.040 Conditions of use – Time limit.
Use of such parking spaces by authorized vehicles shall be only for such times as is necessary for the operation or completion of work by the owner or operator of such vehicle. (Ord. 1620, 2019)
10.16.045 Permit issuance.
Permits shall be issued by the city clerk upon payment of a fee in the sum of $10.00 valid only for the calendar year in which said permit is issued. Only one permit shall be issued for each fee paid to the applicant of a valid city business license to engage in a service or business. (Ord. 1620, 2019)
10.16.046 Transfer and additional permits authorized.
The applicant may transfer said permit from vehicle to vehicle or may obtain additional permits upon payment of the sum of $10.00 for each additional permit issued. (Ord. 1620, 2019)
10.16.050 Penalty established.
Each violation of Article II of this chapter shall be declared a traffic violation and punishable by a fine of no more than $50.00. (Ord. 1620, 2019)
Article III. Recreational Vehicles and Camper
10.16.060 Recreational vehicle and camper defined.
As used herein, the terms “recreational vehicle” (hereafter abbreviated “RV”) and “camper” mean a structure that provides facilities for human habitation or for temporary outdoor or recreational lodging and is five feet or more in overall length and five feet or more in overall height from its floor to its ceiling when fully extended. In addition, a “camper” is mounted upon a motor vehicle and is licensed separately from that vehicle (as opposed to a canopy which is not licensed separately). To further define, the term “RV” encompasses motor homes, travel trailers, fifth wheels and conversion vans. (Ord. 1620, 2019)
10.16.065 Nonconforming RV parking approval.
As used herein, the term “nonconforming RV parking” means either (1) permission granted to an individual or person allowing the individual or person to park an RV or camper in a specified area for a specified amount of time where it is normally unlawful to park such a vehicle, or (2) permission allowing RV and/or camper parking to the general public in a specified area for a specified period of time where it is normally unlawful to park such vehicles.
Requests for approval of nonconforming RV parking shall be reviewed and approved in conjunction with applications for special event permits, building and development permits, and any other activities specifically allowed by any provision of the municipal code.
Requests for approval of nonconforming RV parking that is outside the scope of activities specifically allowed by the municipal code may be made to the city council in writing. The decision of the council shall be final. (Ord. 1620, 2019)
10.16.070 No parking areas identified.
It is unlawful for any person to park at any time, unless by special RV permit issued by the city of Westport, any RV or camper upon the following described rights-of-way in the city of Westport, Washington, to-wit:
(1) Westhaven Drive. The north side of Westhaven Drive from the intersection of Westhaven Drive and Cove Street east to the intersection of Westhaven Drive and Patterson Street in the First Addition to Westhaven, Blocks 6 through 12.
(2) Westhaven Drive. The south side of Westhaven Drive from the intersection of Westhaven Drive and Cove Street east to the intersection of Westhaven Drive and Patterson Street in the First Addition to Westhaven, Blocks 6 through 12.
(3) Sue Hoffman Avenue. The west side of Sue Hoffman Avenue from the intersection of Sue Hoffman Avenue and Westhaven Drive south to the intersection of Sue Hoffman Avenue and Harms Street, adjacent to the First Addition to Westhaven, Blocks 6 and 14.
(4) Sue Hoffman Avenue. The east side of Sue Hoffman Avenue from the intersection of Sue Hoffman Avenue and Westhaven Drive south to the intersection of Sue Hoffman Avenue and Harms Street, adjacent to the First Addition to Westhaven, Blocks 7 and 15.
(5) Carstensen Street. The west side of Carstensen Street from the intersection of Carstensen Street and Westhaven Drive south to the intersection of Carstensen Street and Nyhus Street, adjacent to the First Addition to Westhaven, Blocks 7 and 15.
(6) Carstensen Street. The east side of Carstensen Street from the intersection of Carstensen Street and Westhaven Drive south to the intersection of Carstensen Street and Nyhus Street, adjacent to the First Addition to Westhaven, Blocks 8 and 16.
(7) Harbor Street. The west side of Harbor Street from the intersection of Harbor Street and Westhaven Drive south to the intersection of Harbor Street and Harms Street, adjacent to the First Addition to Westhaven, Blocks 8 and 16.
(8) Harbor Street. The east side of Harbor Street from the intersection of Harbor Street and Westhaven Drive south to the intersection of Harbor Street and Harms Street, adjacent to the First Addition to Westhaven, Block 9, and to the Westhaven Addition, Blocks 1 and 5.
(9) Dock Street. The west side of Dock Street from the intersection of Dock Street and Westhaven Drive south to the intersection of Dock Street and Harms Street, adjacent to the First Addition to Westhaven, Block 9, and to the Westhaven Addition, Blocks 1 and 5.
(10) Dock Street. The east side of Dock Street from the intersection of Dock Street and Westhaven Drive south to the intersection of Dock Street and Harms Street, adjacent to the First Addition to Westhaven, Block 10, and to the Westhaven Addition, Blocks 2 and 4.
(11) City Parking Lot 1 (as posted). Within the boundaries of City Parking Lot 1 in the First Addition to Westhaven, Lot 7, Block 8. (Ord. 1620, 2019)
10.16.075 Parking allowed in City Parking Lot 3.
It is lawful for any person to park but not to camp overnight in any RV or camper upon the following described rights-of-way in the city of Westport, Washington, to-wit:
(1) City Parking Lot 3 (as posted). Within the boundaries of City Parking Lot 3 in the First Addition to Westhaven, Lot 7, Block 6. (Ord. 1620, 2019)
10.16.080 Camping in public areas prohibited.
It is unlawful for any person to occupy for sleeping or dwelling purposes, unless by special RV permit issued by the city of Westport, any RV or camper upon any public street, public alley, or other public area within the corporate limits of the city of Westport for a period of more than three consecutive hours. (Ord. 1620, 2019)
10.16.081 Occupancy must be self-contained.
Occupancy of any RV or camper, as stipulated in WMC 10.16.060, must be in a self-contained manner, meaning that said RV or camper cannot be attached or hooked-up to any outside electrical power, water supply, sewer connection, cable connection or other facilities which are not an integral part of or contained within that RV or camper. In addition, all health and sanitary ordinances of the city of Westport shall be strictly observed and enforced. (Ord. 1620, 2019)
10.16.085 Penalty established.
Each violation of any of the provisions of Article III of this chapter is an infraction punishable by a fine not to exceed $75.00. (Ord. 1620, 2019)
Article IV. Ambulance and Fire Parking
10.16.090 Established and described.
There shall be motor vehicle and service vehicle parking for ambulance and fire department crews only adjacent to the city fire department, located on West Spokane Avenue, at Lot 1, Block 31, Westport Beach Addition to the city of Westport. (Ord. 1620, 2019)
10.16.095 Vehicles to be towed.
If any unauthorized vehicle is located on the above-designated portion of real property, the city shall have said vehicle moved at the expense of the registered owner. (Ord. 1620, 2019)
10.16.098 Penalty established.
Each violation of Article IV of this chapter shall be declared a traffic violation and punishable by a fine of no less than $50.00. (Ord. 1620, 2019)
Article V. Handicapped Parking
10.16.100 Designation of handicapped zones.
The Westport city council is authorized to designate parking areas and drop-off zones for handicapped persons. Such a zone shall be effective upon the construction of the signing and painting for handicapped parking as prescribed by state statute. (Ord. 1620, 2019)
10.16.103 Vehicles must display proper signage.
Any vehicle parked in a designated handicapped area shall bear the properly issued licensed plate, card, decal or other lawful signage as described for disabled persons issued under state statute, RCW 46.16.380. (Ord. 1620, 2019)
10.16.105 Penalty established.
Each violation of Article V of this chapter shall be declared a traffic violation and punishable by the fine established by state statute. (Ord. 1620, 2019)
Article VI. Loading and Unloading Zones
10.16.110 Established and described.
No vehicle shall be parked, within the city of Westport, county of Grays Harbor, state of Washington, except for vehicles loading or unloading commercial or personal cargo, for a period longer than 30 consecutive minutes in a 24-hour period unless otherwise provided for in this chapter within the areas described in this section. 10.16.118 Penalty established.
Each violation of Article VI of this chapter is a traffic infraction punishable by fine of no more than $50.00. (Ord. 1620, 2019)
10.16.119 Area(s) described.
The above loading and unloading zone regulations (Article VI) are applicable to the following areas:
(1) Float 21. Two spaces, each eight feet wide, one located immediately to the east and the other located immediately to the west of the head of Float 21 in Block 13, First Addition to the plat of Westhaven.
(2) Float 19. Two spaces, each eight feet wide, one located immediately to the east and the other located immediately to the west of the head of Float 19 in Block 13, First Addition to the plat of Westhaven.
(3) Float 17. Two spaces, each eight feet wide, one located immediately to the east and the other located immediately to the west of the head of Float 17 in Block 13, First Addition to the plat of Westhaven.
(4) Float 15. Two spaces, each eight feet wide, one located immediately to the east and the other located immediately to the west of the head of Float 15 in Block 13, First Addition to the plat of Westhaven.
(5) Float 11. Two spaces, each eight feet wide, one located immediately to the east and the other located immediately to the west of the head of Float 11 at the end of the Patterson Street extension, First Addition to the plat of Westhaven.
(6) Float 9. Two spaces, one eight feet wide located immediately to the east and the other, 16 feet wide located immediately to the west of the head of Float 9, in front of Block 12, First Addition to the plat of Westhaven.
(7) Float 7. Two spaces, one eight feet wide located immediately to the east and the other 16 feet wide located immediately to the west of the head of Float 7, in front of Block 12, First Addition to the plat of Westhaven.
(8) Float 5. Two spaces, one eight feet wide located immediately to the east and the other, 16 feet wide located immediately to the west at the head of Float 5, in front of Block 11, First Addition to the plat of Westhaven.
(9) Float 3. Two spaces, one eight feet wide located immediately to the east and the other 16 feet wide located immediately to the west of the head of Float 3, in front of Block 11, First Addition to the plat of Westhaven.
(10) Fuel Dock. Two spaces, each 16 feet wide, one located immediately to the east and the other located immediately to the west of the head of the float designated as the fuel dock, in front of Block 10, First Addition to the plat of Westhaven. Each space to be a two-hour loading and unloading zone.
(11) Block 9. First Addition to Westhaven. One space, eight feet wide in front of Lot 5.
(12) Block 9. First Addition to Westhaven. One space, west side of Dock Street, 30 feet alongside the east side of Lot 6.
(13) Block 1. Westhaven Addition to Westport. One space, 12 feet wide, east side of Harbor Street alongside of Lot 12.
(14) Block 5. Westhaven Addition along the west end of Lots 3 through 10.
(15) Float 20. Lot 5, Block 26, First Addition to Westhaven. One space immediately south of the entrance to Float 20 of the Westport Marina, from the westerly boundary of Float 20 and 16 feet westerly thence 10 feet southerly.
(16) Block 20. From a point 70 feet from the south corner of Block 20, plat of First Addition to Westhaven on Westhaven Drive thence northwest from a distance of 55 feet.
(17) Block 11. From a point 60 feet northeast of the south corner of Lot 6, Block 11, First Addition to Westhaven thence northeast along Lamb Street for a distance of 70 feet.
(18) Block 15. From the north corner of Lot 1, Block 15, First Addition to Westhaven thence southeasterly along Nyhus Street for a distance of 45 feet.
(19) Block 9. The first space south of the intersection of Harbor Avenue and Westhaven Drive on the east side of Harbor Avenue, adjacent to Lot 1, Block 9, First Addition to Westhaven. (Ord. 1620, 2019)
Article VII. Alleys
10.16.120 Parking prohibited.
It shall be unlawful for any person to park a vehicle in any designated alley within the city limits of the city of Westport, Washington unless otherwise allowed by state statute, or the Westport Municipal Code. (Ord. 1620, 2019)
10.16.125 Penalty established.
Each violation of Article VII of this chapter shall be declared a traffic violation and punishable by a fine of no less than $50.00. (Ord. 1620, 2019)
Article VIII. Parking in Front of Driveways
10.16.130 Parking in front of driveways prohibited.
It shall be unlawful for any person to park a vehicle in front of any private or city owned designated driveway which abuts, adjoins or is adjacent to any city owned street or right-of-way used solely for ingress or egress. (Ord. 1620, 2019)
10.16.135 Penalty established.
Each violation of Article VIII of this chapter shall be deemed a traffic infraction punishable by a fine of not more than $50.00. (Ord. 1620, 2019)
Article IX. Angle Parking in Streets
10.16.140 Angle parking defined.
There is hereby permitted public parking as angle parking only of vehicles along the below described streets. Every vehicle stopped or parked in the below described streets shall be parked or stopped at a 60-degree angle with its right-hand front wheel abutting the curb or edge of the roadway in the direction of authorized traffic movement. Each violation of Article IX of this chapter shall be declared a traffic infraction punishable by a fine of not more than $50.00. (Ord. 1620, 2019)
10.16.148 Areas described.
The above angle parking regulations (Article IX) are applicable to the following areas:
(1) Westhaven Drive. Along the north and south sides of Westhaven Drive from Patterson Street west to Neddie Rose Drive.
(2) Sue Hoffman Avenue. Along the easterly and westerly sides of Sue Hoffman Avenue from Westhaven Drive south alongside Lot 6, Block 6, and alongside Lot 1, Block 7, all in Westhaven First Addition.
(3) Carstensen Street. Along the easterly and westerly sides of Carstensen Street from Westhaven Drive south alongside Lot 6, Block 7, and alongside Lot 1, Block 8, all in Westhaven First Addition.
(4) Harbor Street. Along the easterly and westerly sides of Harbor Street from Westhaven Drive south alongside Lot 6, Block 8; alongside Lot 1, Block 9, and alongside Lot 2, Block 16, all in Westhaven First Addition. (Note: alongside the other side of Harbor Street is parallel parking only because of no room).
(5) Lamb Street. Along the easterly and westerly side of Lamb Street from Westhaven Drive to Nyhus Street. (Note: parallel parking only from Nyhus to Harms Street because of no room).
(6) Patterson Street. Along the easterly portion of Patterson Street from a point 140 feet southerly of Nyhus Street. Along the westerly side of Patterson Street alongside the easterly side of Lot 6, Block 12, Westhaven First Addition. (The rest are loading/unloading zones).
(7) Nyhus Street. Along the southerly boundary of Lots 8 through 14, Block 2, Westhaven Addition. (The Museum).
(8) Ocean Avenue. Along the northerly portion of Ocean Avenue beginning just west of the intersection of Surf Street, and then continuing in a westerly direction until just before the Westport Light State Park entrance. (Ord. 1620, 2019)
Article X. Parallel Parking
10.16.150 Established and described.
Parallel parking is the only allowed method of parking of vehicles along the streets described in this article. (Ord. 1620, 2019)
10.16.155 Penalty established.
Each violation of Article X of this chapter shall be declared a traffic infraction punishable by a fine of no more than $50.00. (Ord. 1620, 2019)
10.16.158 Area(s) described.
The above parallel parking only zone regulations (Article X) are applicable to the following areas:
(1) South Montesano Street. Along South Montesano Street from Ocean Avenue to the south city limits.
(2) North Montesano Street. Along the east side of North Montesano Street from Ocean Avenue north to Elizabeth Street.
(3) Washington Street. On the south side of Washington Street from North Montesano Street west one block alongside Lot 2 and vacated street, Block 15, Seagrove Addition.
(4) Spokane Street. On Spokane Street from Montesano Street to Ocosta Street.
(5) Cove Street. On the easterly side of Cove Street from Westhaven Drive southerly a distance of 100 feet along Lot 1, Block 6, Westhaven First Addition.
(6) Cove Street. On the westerly side of Cove Street along the easterly portion of Block 1, Westhaven Second Addition.
(7) Dock Street. Along the easterly and westerly side of Dock Street from the intersection of Dock Street and Westhaven Drive south to the intersection of Dock Street and Harms Avenue excepting that portion in front of easterly end of Lots 11 and 12, Block 5, Westhaven Addition which is described with “no parking.”
(8) Nyhus Street. On the north and south sides of Nyhus Street from the intersection of Nyhus Street and Cove Street east to the intersection of Nyhus Street and Wilson Street excluding that portion already described as “angle parking” in front of Lots 8 through 14, Block 2, Westhaven Addition.
(9) Bay Street. On the easterly and westerly sides of Bay Street from the intersection of Bay Street and Nyhus Street south to the intersection of Bay Street and Harms Avenue.
(10) Lamb Street. On the easterly and westerly sides of Lamb Street from the intersection of Lamb Street south to the intersection of Lamb Street and Harms Avenue.
(11) Patterson Street. On the easterly and westerly sides of Patterson Street from the intersection of Patterson Street and Nyhus Street south to the intersection of Patterson Street and Harms Avenue.
(12) Harbor Street. On the easterly side of Harbor Street form the intersection of Harbor Street and Nyhus Street south to the intersection of Harbor Street and Harms Avenue alongside the westerly sides of Lots 19 and 20, Block 5, Westhaven Addition.
(13) East Elizabeth Avenue. Along the southerly and northerly sides of East Elizabeth Avenue from the intersection of East Elizabeth Avenue and Montesano Street to the eastern terminus of East Elizabeth Avenue. (Ord. 1620, 2019)
Article XI. No Parking Zones
10.16.160 Established and described.
No vehicle shall be parked, nor other obstructions allowed including, but not limited to, crab pots, pallets, totes, and/or any other item restricting movement in the areas described below, in the city of Westport, county of Grays Harbor, state of Washington, except as provided for in this chapter. (Ord. 1620, 2019)
10.16.165 Penalty established.
Each violation of Article XI of this chapter shall be declared a traffic violation and punishable by a fine of no more than $50.00. (Ord. 1620, 2019)
10.16.168 Area(s) described.
The above no parking regulations (Article XI) are applicable to the following areas:
(1) Montesano Street north of Harms Avenue. No vehicle shall park on the east side of South Montesano Street commencing from a point from the intersection of Harms Avenue and South Montesano Street, north 200 feet located on the west side of Block 5, also known as Tax Lot 1.
(2) Montesano Street south of Harms Avenue. No vehicle shall park on the east side of South Montesano Street commencing from a point from the intersection of Harms Avenue and South Montesano Street, south 35 feet located on the west side of Block 6, also known as Tax Lot 8.
(3) Nyhus Street, Block 19. Adjacent to the north end of Lots 11 and 12, Block 19, First Addition to the plat of Westhaven.
(4) Nyhus Street, Block 13. Adjacent to the south end of Lot 4, Block 13, First Addition to the plat of Westhaven.
(5) Dock Street. On the west side of Dock Street adjacent to the east end of Lots 11 and 12, Block 5, Westhaven Addition.
(6) Harbor Street. Beginning at the southwest corner of Lot 7, Block 8, Westhaven First Addition, thence northeasterly 80 feet to a 20- by 30-foot area designated “Loading Zone,” where the loading and unloading of vehicles shall be allowed, but not to exceed two hours per vehicle.
(7) Float 4. Thirty feet immediately east of Float 4, First Addition to Westhaven on the north side of Westhaven Drive.
(8) Neddie Rose Drive. The northerly shoulder of Neddie Rose Drive, commencing at the intersection with Westhaven Drive, and thence easterly along Neddie Rose Drive a distance of 650 feet to the beginning of the developed parking area of Block 27, First Addition of Westhaven. This also includes the westerly end of Westhaven Drive, adjacent to the rock revetment.
(9) Garbage Containers. It shall be unlawful to park or leave unattended any vehicle so as to block access to the garbage containers by the city’s contractor or any user of garbage containers.
(10) Wilson Street and Jetty Haul Road (South Jetty Right-of-Way). Thirty feet on both sides of Wilson Street above and below Jetty Haul Road (South Jetty Right-of-Way).
(11) Northeast Portion of Harms Drive. Beginning at the northeast corner of South Montesano Street and Harms Drive extending 200 feet east on the north side of Harms Drive.
(12) Northerly and southerly sides of Hancock Street beginning at South Surf Street to and including the pedestrian beach access except as posted, and all of Dune Crest Loop beginning and ending at Hancock Street.
(13) South Surf Street and South Johnson Street, south of West Lila Avenue.
In addition to other penalties provided in this chapter, the Westport police department may have vehicles parked in violation of this section towed at the owner’s expense. (Ord. 1690, 2024; Ord. 1620, 2019)
Article XII. Thirty-Minute Parking
10.16.170 Established and described.
No motor vehicle shall be parked for more than 30 consecutive minutes in a 24-hour period in the areas described in this section. (Ord. 1620, 2019)
10.16.180 Penalty established.
Each violation of Article XII of this chapter shall be deemed a traffic infraction punishable by a fine of no more than $50.00. (Ord. 1620, 2019)
10.16.185 Area(s) described.
The above 30-minute parking regulations (Article XII) are applicable to the following areas:
(1) Westhaven Drive. On the north side of Westhaven Drive between the intersection of Dock Street and Westhaven Drive thence westerly to the end of the concrete walking area known as the Esplanade, Grays Harbor County.
(2) North Montesano Street. On the east side of North Montesano Street in front of Westport Beach Lots 11 and 12, Block 14, known as City of Westport Council Chamber, beginning at the intersection with East Pacific Avenue, and thence northward until the beginning of the parking lot located on the north end of said lots. This restriction is in effect between the hours of 8:00 a.m. and 5:00 p.m., on Monday through Friday except on legal holidays.
(3) North Montesano Street. On the east side of north Montesano Street in front of Bayview Lots 1 and 2, Block 5, known as the Westport Police Department, beginning at the driveway in at the south side of the building and thence northward until the intersection with East Washington Avenue. This restriction is in effect between the hours of 8:00 a.m. and 5:00 p.m., on Monday through Friday except on legal holidays.
(4) Dock Street. On the west side of Dock Street beginning at the southeasterly property line of the southeasterly 1/2 of Lot 2, Block 5, Westhaven Addition thence northward for approximately four feet, and thence beginning at the same southeasterly property line of the southeasterly 1/2 of Lot 2, Block 5, Westhaven Addition southward approximately 16 feet. Article XIII. Three-Hour Parking
10.16.190 Established and described.
There is hereby established a three-hour parking zone in the district commonly known as the dock area within the city limits of the city of Westport, Washington. (Ord. 1620, 2019)
10.16.200 Does not affect other zone designations.
There are already established various parking zones within this area such as, but not limited to, police, fire, and service vehicle parking zones which shall take precedence over three-hour parking within the area described in WMC 10.16.215. (Ord. 1620, 2019)
10.16.205 Effective dates.
Except as noted herein, the three-hour parking regulations called for in this article shall be in effect from 8:00 a.m. to 8:00 p.m. daily from April 15th through October 15th of each year. The portions of Westhaven Drive described in WMC 10.16.215(1), (2), (3), (4), (5), and (6), the portions of Dock Street described in WMC 10.16.215(11) and (12), and Nyhus Street described in WMC 10.16.215(13) and (14) shall remain three-hour parking year round. 10.16.210 Penalty established.
Each violation of Article XIII of this chapter shall be declared a traffic violation and be punishable by a fine of $50.00. (Ord. 1620, 2019)
10.16.215 Area(s) described.
The above three-hour regulations (Article XIII) are applicable to the following areas:
(1) Westhaven Drive. The southerly side of Westhaven Drive along the north side of Block 6, between Cove Street thence east to Sue Hoffman Avenue, Westhaven First Addition to Westport.
(2) Westhaven Drive. The southerly side of Westhaven Drive along the north side of Block 7, between Sue Hoffman Avenue thence east to Carstensen Street, Westhaven First Addition to Westport.
(3) Westhaven Drive. The southerly side of Westhaven Drive along the north side of Block 8, between Carstensen Street thence east to Harbor Street, Westhaven First Addition to Westport.
(4) Westhaven Drive. The southerly side of Westhaven Drive along the north side of Block 9, between Harbor Street thence east to Dock Street, Westhaven First Addition to Westport.
(5) Westhaven Drive. Adjacent to Lot 1 less than 50 feet, Block 9, Westhaven First Addition, adjacent to Granny Hazel’s Candy Store, Grays Harbor County, Washington.
(6) Westhaven Drive. Three consecutive parking stalls ending at the easterly corner of Westport Acreage Tax Lot 2.
(7) Sue Hoffman Avenue. The easterly side of Sue Hoffman Avenue along the west side of Lot 1, Block 7, and the westerly side of Sue Hoffman Avenue along the east side of Lot 6, Block 6, all within the plat of Westhaven First Addition to Westport.
(8) Carstensen Street. The easterly side of Carstensen Street along the west side of Lot 1, Block 8, and the westerly side of Carstensen Street along the east side of Lot 6, Block 7, all within the plat of Westhaven First Addition to Westport.
(9) Harbor Street, First Addition. The easterly side of Harbor Street along the west side of Lot 1, Block 9. The westerly side of Harbor Street along the east side of Lot 6, Block 8, all within the plat of Westhaven First Addition to Westport.
(10) Harbor Street, Westhaven. The easterly side of Harbor Street along the west side of Lot 12, Block 1, plat of Westhaven.
(11) Dock Street, First Addition. The westerly side of Dock Street along the east side of Lot 6, Block 9. The easterly side of Dock Street along the west side of Lots 1 and 2, Block 10, First Addition to Westhaven.
(12) Dock Street, Westhaven. The westerly side of Dock Street along the easterly ends of Lots 1 through 4, Block 1. The easterly side of Dock Street along the westerly ends of Lots 1 through 4, Block 2. The westerly side of Dock Street alongside the easterly ends of Lots 1 through 5, Block 4. The westerly side of Dock Street along the easterly end of Lots 1 and 2, Block 5, all within the plat of Westhaven Addition to Westport.
(13) Nyhus Street. The northerly side of Nyhus Street along the entire south end of Block 1, between Harbor Street thence east to Dock Street, Westhaven Addition to Westport.
(14) Nyhus Street. The northerly side of Nyhus Street along the south side of Block 2, from Lot 4 through Lot 14, inclusive between Dock Street thence east to the northerly extension of Bay Street all within the plat of Westhaven Addition to Westport.
(15) Nyhus Street. The southerly side of Nyhus Street along the entire north side of Block 4, between Dock Street thence east to Bay Street, Westhaven Addition to Westport.
(16) Nyhus Street. The southerly side of Nyhus Street along the entire north end of Block 5, between Harbor Street thence east to Dock Street, Westhaven Addition to Westport. (Ord. 1620, 2019)
Article XIV. All Day Parking
10.16.220 All day parking defined.
“All day parking” is defined as parking for a term of no more than 24 consecutive hours. Any additional stipulations and/or restrictions that may exist for specific all-day parking areas are outlined in this article. (Ord. 1620, 2019)
10.16.225 Penalty established.
Violation of any of the provisions of Article XIV of this chapter is an infraction punishable by a fine not to exceed $50.00. (Ord. 1620, 2019)
10.16.230 Recreational/oversized vehicles not allowed.
It is unlawful to park or cause to be parked, at any time, any recreational vehicle, camper or any oversized vehicle within this area unless by special permit issued by the city of Westport. (Ord. 1620, 2019)
10.16.235 Storage not allowed.
It is unlawful to store any type of equipment and/or stage crab pots in this area unless by written authorization issued by the city council of Westport and according to any stipulations contained within any such agreement. (Ord. 1620, 2019)
10.16.238 Area(s) described.
Locations for specific all day parking areas (Article XIV) within the city of Westport, Washington are as follows:
(1) City Parking Lot 1 (as posted). Within the boundaries of City Parking Lot 1 in the First Addition to Westhaven, Lot 7, Block 8.
(2) Nyhus Street. Beginning at the southwest corner of Lot 12, Block 1, Westhaven Addition, going 80 feet southeasterly along the northern portion of Nyhus Street. (Ord. 1620, 2019)
Article XV. Long-Term Parking
10.16.240 Long-term parking defined.
“Long-term parking” is hereby defined as a period of no more than 96 consecutive hours. (Ord. 1273, 2002)
10.16.250 Violation prohibited.
It is unlawful for any person to park or cause to be parked any vehicle, camper or recreational vehicle for a term longer than 96 consecutive hours in the above described in WMC 10.16.240. (Ord. 1620, 2019)
10.16.260 Penalty established.
Each violation of Article XV of this chapter shall be deemed a traffic infraction punishable by a fine not to exceed $50.00. (Ord. 1620, 2019)
10.16.265 Area(s) described.
Locations for specific long-term parking areas (Article XV) within the city of Westport, Washington are as follows:
(1) City Parking Lot 2 (as posted). Located in all of Lot 7, Block 7, First Addition to Westhaven. (Ord. 1620, 2019)
Article XVI. Westerly End of Ocean Avenue
10.16.270 No parking within the turnaround.
No motor vehicle shall be parked within the turnaround area at the westerly end of Ocean Avenue at any time. (Ord. 1620, 2019)
10.16.280 Restrictions on RVs and campers.
There shall be no recreational vehicles or campers allowed west of the Washington State Lighthouse State Park entrance. (Ord. 1620, 2019)
10.16.290 Fifteen-minute vehicle parking.
No motor vehicle shall be parked more than 15 minutes at the designated parking area at the most westerly end of Ocean Avenue. The handicap-parking stall is regulated by state guidelines. (Ord. 1620, 2019)
10.16.295 Penalty established.
Each violation of Article XVI of this chapter shall be declared a traffic violation and punishable by a fine of $50.00. (Ord. 1620, 2019)
Article XVII. Neddie Rose Drive
10.16.300 Definitions.
“Boat trailer” means a vehicle, without motor power, designed and constructed for the purpose of transporting a boat over public roads.
“Overnight parking” means to be parked for greater than three hours between the hours of 11:00 p.m. and 7:00 a.m. (Ord. 1620, 2019)
10.16.310 Boat trailer regulations.
It is unlawful for any person or persons to park or cause to be parked, at any time, any boat trailer, loaded or unloaded, on any portion of Neddie Rose Drive and Lot 27, First Addition to Westhaven, between Westhaven Drive and its northeasterly termination for more than two hours. (Ord. 1620, 2019)
10.16.320 No overnight parking.
No overnight parking of any RV, travel trailer that travels over roadways, or storage of any type of equipment, vehicle trailer that travels over roadways, is allowed along Neddie Rose Drive and Lot 27, First Addition to Westhaven. (Ord. 1620, 2019)
10.16.330 Crab pot staging may be authorized.
The mayor or his designee may authorize, with certain conditions, crab pot staging in specific areas along Neddie Rose Drive, Lot 27, First Addition of Westhaven, and the municipal parking lots; Lot 7 of Blocks 6, 7, and 8, First Addition of Westhaven; subject to the following conditions:
(1) Staging may be authorized during the months of September through January.
(2) Staging will not exceed 120 days at any one location.
(3) The usage must be authorized by written agreement with the user and the city of Westport.
(4) Staged pots will be clean and not contain any bait or fish/shellfish parts in the pots.
(5) The user will acknowledge in writing that they are responsible for the proper stacking and location of pots so as not to impede or present a danger to vehicular or pedestrian traffic in the area the pots are stored.
(6) The applicant shall indemnify, defend and hold the city of Westport harmless for any and all claims of every nature regarding said staging.
(7) The mayor or his designee may (in writing) revoke said authorization at their sole discretion. (Ord. 1620, 2019)
10.16.335 Penalty established.
Each violation of Article XVII of this chapter shall be declared a traffic violation and punishable by a fine of $50.00. (Ord. 1620, 2019)
Article XVIII. General Provisions
10.16.340 Marking authority.
The city of Westport’s public works director, street supervisor, or enforcement official as designated by the mayor is hereby authorized to identify the areas described herein and order to be installed appropriate signage, painted lines, or other forms of marking as deemed necessary. (Ord. 1620, 2019)
10.16.345 Conflicting ordinances, resolutions or policies repealed.
Any ordinance, resolution or other action or portion thereof in conflict with this chapter is hereby repealed. (Ord. 1620, 2019)
10.16.350 Each violation constitutes separate offense.
Each violation of the ordinance codified in this chapter constitutes a separate offense. The penalty for each subsequent violation of any section of this chapter within a 30-day period shall result in the penalty doubling for each subsequent offense up to a maximum of $500.00 per violation. (Ord. 1273, 2002)
10.16.355 Prohibited parking.
All vehicles (auto, truck, RV, trailer, etc.) must park properly within pavement markings which indicate designated parking stalls. (Ord. 1620, 2019)
10.16.356 Blocking/obstructing prohibited.
No vehicle shall be parked, or other obstructions allowed including, but not limited to, crab pots, pallets, totes and/or any other item restricting movement, unless otherwise provided for in this chapter. Vehicles must be parked in a manner as not to block sidewalks, alleyways, streets, float ramp openings, fire protection devices, emergency services vehicle access, designated disabled parking or other access points. 10.16.360 Removal, storage and disposal of unauthorized property.
Any unauthorized property which the city determines needs to be removed from any parking area may be removed by the city at the owner’s expense. In the event the city determines the property should be disposed of, the city may do so at the owner’s expense with no liability toward the city. The city may also store said property and charge the owner a reasonable storage fee, which shall be paid prior to the property being released. (Ord. 1620, 2019)
10.16.365 Vehicles to be towed.
If any unauthorized vehicle pertained in the entirety of this code is located on the above-designated portions of real property, the city may have said vehicle moved at the expense of the registered owner. (Ord. 1620, 2019)
10.16.366 Vehicles being towed for special events.
When the public roadway or a public parking area is to become a special event venue pursuant to a special event permit, and vehicles parked in the roadway or public parking area will create a hazard or will otherwise interfere with the operation of the special event, the event organizer may request permission from the Westport police department to relocate or remove the vehicles. With properly posted signage, or due to the exigency of the special event itself, any vehicle on the public roadway or public parking area within the special event venue may be considered as abandoned and thereby removed by the contracted towing company of the Westport police department pursuant to Chapter 10.24 WMC, Abandoned Vehicles. 10.16.370 Prompt payment provision.
A 50 percent reduction of the fine amount shall apply to all fines paid (at the locations listed on the citation issued) not later than the close of business the business day following the issuance of the citation for violations of Articles XII, XIII, XVI and XVII of this chapter. (Ord. 1620, 2019)
10.16.375 Event parking notification.
When the roadway or public parking are to be closed due to special event(s) “no parking” signage will be installed 24 hours in advance of parking and lane closures. Signage shall establish the date and hours for no parking. (Ord. 1620, 2019)
10.16.380 Penalty established.
Each violation of Article XVIII of this chapter shall be declared a traffic violation and punishable by a fine of $50.00, towing of violating vehicle or both. (Ord. 1620, 2019)
