18.55.010 Purpose.
To serve as a general commercial zone and to provide for the location of commercial development of a more intense character (heavy commercial). [Ord. 508 § 3.14.0, 1982].
18.55.020 Intent.
To encourage the more extensive commercial development to locate along appropriate sections of South Main Avenue while protecting the overall visual character and appearance of the area. To preserve this intent, manufacturing of products other than that which is clearly incidental to the business conducted on the premises will not be permitted. Outdoor storage areas which are inherent to the operation are permitted; provided, that all storage areas are concealed (screened) from view of neighboring properties and abutting streets (use of plant materials for screening is encouraged). Storage areas considered potentially hazardous shall be enclosed. [Ord. 508 § 3.14.1, 1982].
18.55.030 Permitted uses and structures.
The following uses and structures and similar uses and structures are permitted outright, provided there is no noise, odors, smoke, vibration or other deleterious influences detectable beyond the property line.
(1) Retail Sales.
(a) Agricultural supply store.
(b) Appliance (household and small appliance). Appliance sales and service, provided outside storage areas are fenced and screened.
(c) Auction house (excluding livestock and vehicles), provided outside storage areas are fenced and screened (exterior display areas are prohibited).
(d) Automobile sales lots (including sales or rental of boats, recreational vehicles, travel trailers, light duty trucks and similar vehicles, whether new or used).
(e) Automobile supply and parts store.
(f) Bakery, provided the principal operation is for retail sales on the premises.
(g) Bicycle sales and repair shop.
(h) Book, stationery and business supply store.
(i) Clothing store.
(j) Contractors’ sales and repair shop (such as plumbing, heating, electrical and glass, provided outside storage areas are fenced and screened).
(k) Convenience store or market.
(l) Department, variety, dry goods or notions store.
(m) Florist.
(n) Food and drug store, meat market (retail).
(o) Furniture store.
(p) Garden supply, nursery or greenhouse, provided the principal operation is for retail sales on the premises and provided outside storage areas are screened.
(q) Hardware and building supply, provided outside storage areas are fenced and screened.
(r) Interior decorating shop (such as floor covering, wallpaper and drapery sales).
(s) Jewelry or gift store.
(t) Musical instrument, record or tape sales.
(u) Pet store, including supplies and grooming.
(v) Secondhand goods store/pawn shop, provided outside storage areas are fenced and screened (exterior display areas are prohibited).
(w) Shoe store or shoe repair.
(x) Sign shop (painting and sales), provided outside storage areas are fenced and screened.
(y) Sporting equipment sales.
(z) Toy or hobby sales.
(aa) Wholesale office and showroom with merchandise on the premises limited to small parts and samples.
(bb) Marijuana-related land uses as defined within MCMC 18.10.030 and as regulated within MCMC 18.75.130.
(2) Services and Trades.
(a) Ambulance/emergency service.
(b) Audio-visual or recording studio.
(c) Automobile repair garage (provided there is no heavy duty truck or equipment repair and all storage areas are screened).
(d) Automobile service station (excluding major repair).
(e) Bank or savings and loan.
(f) Beauty or barber shop.
(g) Bonding company, detective agency.
(h) Car wash.
(i) Dressmaking, millinery or tailor shop.
(j) Dry cleaning establishment (retail) containing less than 3,000 square feet of processing area and excluding those using highly volatile or combustible material or using high pressure steam tanks or boilers.
(k) Laundromat or dry cleaning (self-service).
(l) Locksmith.
(m) Mailing or addressing service, provided fleet vehicle storage areas are screened.
(n) Parcel delivery service, provided fleet vehicle storage areas are screened.
(o) Photocopy/blueprinting service.
(p) Professional offices.
(q) Stenographic service, notary public.
(r) Taxidermy shop conducted wholly within an enclosed building (no outside storage or display permitted).
(s) Taxi dispatch center.
(t) Telephone answering service.
(u) Upholstery shop or furniture repair, provided outside storage areas are fenced and screened.
(3) Institutional and Instructional.
(a) Child day care facilities (see MCMC 18.75.050).
(b) Mortuary, undertaking and funeral parlor conducted wholly within an enclosed building (except crematorium).
(c) Museum.
(d) Philanthropic or eleemosynary institution.
(e) Preschool/kindergarten/nursery school.
(f) Residential care facility.
(g) Schools, business or trade (which are similar to permitted uses).
(h) Studio (including music, dance, art, crafts, health or photography).
(4) Amusement and Recreation.
(a) Auditorium, exhibition hall or community building.
(b) Club, lodge or fraternal organization facility.
(c) Golf, miniature.
(d) Indoor amusement enterprise (including arcade, pool hall, bowling alley, skating rink, etc.).
(e) Recreation club/health spa.
(f) Restaurant, cafe, delicatessen, including fast-food restaurant.
(g) Tavern, cocktail lounge.
(h) Theater, indoor.
(5) Miscellaneous and Accessory Uses.
(a) All accessory uses and structures meeting the “limitations and exceptions” as set forth in Chapter 18.75 MCMC.
(b) Apartments (as a secondary use; defined in Chapter 18.10 MCMC).
(c) Bed and breakfast.
(d) Bus or similar public transportation facility.
(e) Hotel, motel or motor court.
(f) Laboratory (medical, dental, experiment, research or testing), provided all outside storage areas are fenced and screened.
(g) Parking structure or public parking lot.
(h) Printing (including newspaper), publishing or engraving service containing less than 5,000 square feet of processing area and conducted wholly within an enclosed building.
(i) Rubber or metal stamp manufacture, provided the principal operation is for retail sales on the premises.
(j) Single-family dwelling, limited to homes currently listed on the Myrtle Creek historic resources register.
(k) Veterinary office or animal hospital, provided there are no outside runs or pens. [Ord. 807 § 1 (Exh. A), 2016; Ord. 800 § 2, 2015; Ord. 508 § 3.14.2, 1982].
18.55.040 Conditional uses and structures.
The following uses and structures and similar uses and structures are permitted as a conditional use subject to the procedures of Chapter 18.170 MCMC, whereupon (1) a conditional use permit may be granted when the criteria for approval are met or can be met by observance of conditions; or (2) a conditional use permit may be denied if the findings of fact conclude that the permit criteria cannot be met.
(1) Automobile tire sales (including tire recapping), provided outside storage areas are fenced and screened.
(2) Cabinet shop and similar wood products manufacturing, provided the principal operation is for retail sales on the premises and any outside storage is fenced and screened.
(3) Drive-up windows and stalls for existing uses (i.e., banks).
(4) Film exchange and other drive-in/drive-up/drive-through drop boxes.
(5) Horticultural nursery/greenhouse (commercial distributor).
(6) Ice manufacture, warehouse storage and dispensing facility conducted wholly within an enclosed building; and provided, that fleet vehicle storage is screened.
(7) Mobile home sales lot.
(8) Planned development/commercial or professional office subject to the approval criteria set forth in Chapter 18.130 MCMC.
(9) Schools, business or trade, which are similar to uses permitted conditionally.
(10) Theater, outdoor (drive-in).
(11) Storage yard for freight trucks and trailers, provided storage areas are fenced and screened as required by Chapter 18.110 MCMC.
(12) Heavy truck and trailer repair limited to routine maintenance, provided storage of materials is completely enclosed within a structure and truck parking areas are fenced and screened as required by Chapter 18.110 MCMC.
(13) Other similar uses and structures.
(14) Marijuana-related land uses as defined within MCMC 18.10.030 and as regulated within MCMC 18.75.130. [Ord. 807 § 1 (Exh. A), 2016; Ord. 508 § 3.14.3, 1982].
18.55.050 Dimensional standards.
(1) Yard Requirements (See Chapter 18.145 MCMC for Exceptions).
(a) The minimum side yard shall be 15 feet where adjoining any residential district.
(b) The minimum rear yard shall be 25 feet where adjoining any residential district.
(c) Buffer yards shall consist of landscaping and improvements in accordance with the standards for commercial and industrial uses contained in Chapter 18.110 MCMC.
(2) Building Height (See Chapter 18.145 MCMC for Exceptions). The height of a building in the C-3 district shall not exceed 50 feet.
(3) Minimum Zone Size. Areas proposed for zone change to C-3 shall be contiguous to an existing C-3 district or shall consist of a minimum of three acres. [Ord. 508 § 3.14.4, 1982].
18.55.060 Development standards and review criteria.
Notwithstanding the conditional use provisions of MCMC 18.55.040, any project involving the erection of a new building or structure, the enlargement in height or ground coverage, or the intensification of use of any building or structure shall:
(1) Be reviewed in accordance with the site review criteria contained in Chapter 18.150 MCMC. The planning department shall conduct the site review for permitted uses that meet all ordinance requirements, whereas the planning commission or city administrator or the city administrator’s designee shall conduct the site review for conditional uses, variances and other similar procedures as stipulated in the applicable regulations; and
(2) Provide improvements and comply with the design standards applicable to the type of development proposed as set forth in Chapter 18.150 MCMC; and
(3) Provide off-street parking as set forth in Chapter 18.90 MCMC. [Ord. 508 § 3.14.5, 1982].
